Liability Waiver Agreement

Definitions: This Liability Waiver ("Agreement") is entered into between the undersigned participant ("Participant" or "I") and M&S Sublets & Services, its staff, and affiliates ("M&S Sublets & Services"). The following definitions clarify the terms used within this Agreement:

"M&S Sublets & Services," "its staff," and "affiliates": These terms collectively refer to M&S Sublets & Services, including its employees, representatives, contractors, volunteers, and any associated entities acting on behalf of M&S Sublets & Services LLC.
"I," "me," and "participant": These terms refer to the individual attending the trip and signing this Liability Waiver, acknowledging its terms and conditions.

I. Assumption of Risks: I, , hereby acknowledge and agree to the following terms and conditions in consideration for being allowed to participate in any trip organized by M&S Sublets & Services LLC.

I. Release and Waiver: In consideration for being permitted to participate in the trip, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release and discharge M&S Sublets & Services LLC, its officers, employees, agents, and representatives from any and all claims, liabilities, demands, actions, or causes of action that may arise out of or in connection with my participation in the trip.

II. LIABILITY WAIVER / RISK ACKNOWLEDGEMENT: I, the undersigned, understand that participation in trip activities involves a risk of physical injury, illness, death, or property loss. Despite safety precautions, M&S Sublets & Services cannot guarantee safety, as all risks cannot be prevented.

I. Responsibility for Personal Property: I understand that I am solely responsible for my personal belongings and any equipment or gear I bring on the trip. I release M&S Sublets & Services LLC from any liability for loss or damage to my personal property.

II. Medical Authorization: In the event of a medical emergency, if my Trip Leader determines that I am incapacitated or unable to make decisions for myself, I hereby grant full authorization to my Trip Leaders to seek and obtain any necessary medical treatment on my behalf. I agree to be responsible for any costs incurred as a result of such medical treatment.

III. Third-Party Services: I acknowledge that during the trip, I may be provided services by third-party companies, tour guides, or other entities hired by, but not directly affiliated with M&S Sublets & Services. In such instances, I understand that all liability is fully removed from M&S Sublets & Services. I agree to comply with any additional terms or waivers set forth by third-party entities and acknowledge that I am responsible for managing any grievances or incidents that may arise and protecting M&S Sublets & Services LLC at all costs.

IV. Compliance with Laws: I agree to comply with all laws, rules, and regulations of the country and locations visited during the trip.

V. Governing Law: This agreement shall be governed by and construed in accordance with the laws of Nevada, and any legal action or proceeding arising out of or relating to this agreement shall be brought in the courts of Nevada.

VI. Severability: If any provision of this Agreement is found to be unenforceable or invalid, such provision shall be severed from this Agreement and the remaining provisions shall remain in full force and effect.

VII. Photo and Video Release: I grant permission to M&S Sublets & Services LLC to use photographs and/or video recordings of me taken during the trip for promotional and marketing purposes without compensation.

IX. Force Majeure: M&S Sublets & Services LLC shall not be liable for any delay or failure to perform its obligations under this Agreement if such delay or failure is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes, government regulations, natural disasters, or other events of force majeure.

X. Acknowledgment of Understanding: I have read this Liability Waiver Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

In consideration of the opportunity afforded and with full knowledge of the risks associated with this trip, I hereby release, indemnify, and hold harmless M&S Sublets & Services, its staff, trip leaders, agents, and volunteers from all claims, suits, and demands arising from my participation in said trip or activities.
