These Terms govern your use of our website and app, your bookings and payments, and your participation in any tour or group trip operated by Atomic.

1. Scope; Acceptance; Applicability

1.1 Scope.

These Terms and Booking Conditions govern:

• Your access to and use of Atomic’s website and mobile application (the “Site” and “Atomic App”);
• The creation and use of user accounts;
• Inquiries, reservations, bookings, payments, invoices, and related communications; and
• Participation in any tour, trip, program, or related services operated or arranged by Atomic (each, a “Tour”).

1.2 Applicability by Departure Date.

These Terms apply to all Tours departing on or after October 1, 2023, or such later date as we may specify in updated Terms. For Travelers with existing accepted bookings, a materially updated version of these Terms will apply prospectively from the effective date specified in the update.

1.3 Acceptance by Enrollment and Use.

Your enrollment in a Tour, submission of a reservation, and/or any payment toward a Tour constitutes your acceptance of these Terms. Your use of the Site and Atomic App constitutes acceptance of the then-current version of these Terms.

1.4 Clickwrap Consent.

Atomic may require you to affirmatively accept these Terms via a checkbox, “I Agree” button, or similar mechanism at one or more points, including but not limited to:

• At checkout or account creation; and
• Immediately before final payment or departure.

You may not enroll or travel unless you have accepted these Terms.

1.5 Updates to Terms.

Atomic may update these Terms at any time before a booking is accepted. For Travelers with accepted bookings, Atomic will notify you of any material changes by email and/or through the Atomic App, and such changes will apply prospectively from the effective date stated in the notice, except as required by mandatory law.

2. Definitions

For purposes of these Terms:

2.1 “Atomic,” “we,” “us,” and “our”.

“Atomic,” “we,” “us,” and “our” mean M&S Sublets & Services LLC d/b/a Atomic Trips, together with its successors and permitted assigns.

2.2 “You,” “your,” and “Traveler”.

“You,” “your,” and “Traveler” mean the individual who accesses the Site or Atomic App, creates an account, enrolls in or pays for a Tour, or participates in a Tour, and any parent or legal guardian providing consent for a minor Traveler.

2.3 “Booking Conditions” and “Terms”.

“Booking Conditions” and “Terms” mean these Terms of Service and Booking Conditions, together with any incorporated policies, notices, schedules, addenda, and exhibits.

2.4 “Program Price”.

“Program Price” means the per-person price for a Tour, as advertised or quoted by Atomic, in U.S. Dollars (USD). Unless stated otherwise, the Program Price includes:

• A 12%-29% conversion and processing component used to cover euro conversion and related processing costs;
• Any other disclosed surcharges and fees; and
• Applicable taxes and assessments that Atomic has agreed to collect on your behalf.

The Program Price may be adjusted as described in Sections 4, 18, 19, and 20.

2.5 “Group Leader”.

“Group Leader” means the person, school, organization, influencer, or other designated organizer responsible for coordinating a group’s participation in a Tour and serving as the primary liaison with Atomic before and during travel.

2.6 “Tour Director”.

“Tour Director” means the Atomic-designated representative leading, accompanying, and managing the Tour on the ground, including enforcing conduct and safety policies.

2.7 “Third-Party Provider”.

“Third-Party Provider” means any independent contractor or company providing accommodations, ground transportation, attractions, activities, meals, or other services in connection with a Tour, including hotels, local operators, and guides.

2.8 “Atomic App”.

“Atomic App” means Atomic’s official mobile application used for trip management, communications, hotel assignments, ticketing, itinerary access, and other on-trip functionalities.

2.9 “Invoice”.

“Invoice” means the official Atomic invoice (or equivalent system record) issued to a Traveler or group, which is the authoritative record of the total Program Price, any adjustments, and the outstanding balance.

2.10 “Spiffy”.

“Spiffy” means the billing website and payment gateway used by Atomic to process scheduled payments and stand-alone charges. Due to system limitations, Spiffy may not always reflect the full Invoice totals.

2.11 “Non-Refundable Fees”.

“Non-Refundable Fees” has the meaning set out in Section 18.

2.12 “Down Payment”.

“Down Payment” means the initial, nonrefundable and nontransferable 15% payment due upon enrollment, as further described in Sections 16, 17, and 18.

2.13 “Force Majeure”.

“Force Majeure” means events beyond Atomic’s reasonable control, including, without limitation: pandemics or epidemics; public health emergencies; government travel warnings or restrictions; severe weather; natural disasters; war; acts of terrorism; civil unrest; strikes; labor disputes; governmental orders or advisories; quarantines; sanctions; transportation or infrastructure disruptions; contamination; or other extraordinary events or circumstances that significantly impair or prevent performance.

2.14 “Future Travel Voucher”.

“Future Travel Voucher” means a voucher issued by Atomic with a stated value redeemable toward a future Tour, subject to applicable voucher terms and Section 20.

2.15 “Late Enrollment”.

“Late Enrollment” means an enrollment submitted within 60 days of the scheduled departure date for the Tour.

2.16 “Replacement Traveler”.

“Replacement Traveler” means a person who replaces an enrolled Traveler, where permitted, in accordance with Section 19.

2.17 “No-Show”.

“No-Show” means a Traveler’s failure to appear for the Tour on the day of departure without written notice to Atomic at least seven (7) business days in advance.

2.18 “Paperless Billing”.

“Paperless Billing” means Atomic’s electronic invoicing and document delivery model, as described in Sections 15 and 16.

2.19 “Automatic Payment Plan”.

“Automatic Payment Plan” means a recurring payment plan arranged through Spiffy using ACH or a debit card with a Visa/Mastercard logo, as described in Sections 16 and 17.

2.20 “Manual Payment Plan”.

“Manual Payment Plan” means a non-recurring, manually initiated payment plan that is subject to a nonrefundable fee, as described in Sections 16 and 17.

3. Eligibility and User Accounts

3.1 Legal Capacity and Age.

You must have legal capacity to contract to book or enroll in a Tour. Travelers must be at least 18 years old to travel independently. The minimum travel age is 14. Travelers aged 14–17 must:

• Travel with a designated adult chaperone (who is not the Group Leader); and
• Room with that designated chaperone, unless Atomic specifically approves an alternative.

3.2 Residency.

Atomic primarily serves U.S.-based customers. These Terms apply regardless of your citizenship or residence. To the extent required by mandatory consumer protection laws in your jurisdiction, those laws may apply and may provide you with non-waivable rights.

3.3 Accounts and Security.

You agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials confidential; and
• Notify Atomic promptly of any suspected unauthorized use or security breach.

You are responsible for all activity that occurs under your account.

3.4 Fraud Screening; Refusal of Service.

Atomic may conduct fraud screening and reserves the right to refuse, suspend, or cancel any booking or account for suspected fraud, misuse, abusive conduct, or violation of these Terms.

3.5 Sanctions and Export Controls.

You represent that you are not subject to U.S. or other applicable sanctions and will not use the Site/App or participate in Tours in violation of export control laws, OFAC regulations, or other applicable sanctions regimes.

4. Contract Formation and Trip Window

4.1 Formation of Contract.

A binding agreement is formed between you and Atomic when:

• You submit a reservation or enrollment; and
• Atomic accepts it, which may be indicated by a confirmation email, an updated status in the Invoice system, or provision of access to Tour content in the Atomic App.

Your enrollment and any payment toward a Tour constitute acceptance of these Terms.

4.2 Trip Window.

The Tour begins upon your arrival at the first Atomic-designated hotel and ends upon your departure from the last Atomic-designated hotel, as described on your booking confirmation and official itinerary. Any stay-ahead or stay-behind arrangements, independent travel, or non-Atomic activities before or after this window are entirely outside the Tour and outside Atomic’s responsibility.

5. Pricing, Currency, Taxes, and Fees

5.1 Currency.

All prices are quoted and payable in U.S. Dollars (USD).

5.2 Inclusions and Exclusions.

Program Price inclusions and exclusions are set forth in Sections 6 and 7. Only items explicitly listed as included are part of the Program Price.

5.3 19% Conversion and Processing Fee.

• A 19% conversion and processing component applies to cover euro conversion, international banking costs, and related processing expenses.
• This component is included within the advertised Program Price, which is presented as a single total price to the Traveler.
• The 19% conversion and processing component is nonrefundable in all cases, except to the limited extent required by mandatory consumer protection law.

5.4 Taxes and Assessments.

Unless expressly stated otherwise:

• City or hotel tourist taxes are not included in the Program Price and must be paid directly to hotels or local authorities; and
• Other applicable taxes, assessments, and government fees not collected by Atomic will be passed through or remain your responsibility.

5.5 Pricing Errors and Obvious Mistakes.

Atomic may correct obvious errors, omissions, or technical glitches in pricing or published information at any time, including after you submit a reservation or make payment, to the fullest extent permitted by applicable law. An “obvious error” includes, without limitation, pricing that is clearly inconsistent with the scope, length, or inclusions of the Tour, or that results from a system or typographical mistake.

If Atomic corrects an obvious error that affects your booking, Atomic may, in its sole discretion:

(a) allow you to maintain the booking by paying or receiving the difference between the erroneous amount and the corrected amount; or
(b) cancel the affected booking in whole or in part.

If Atomic cancels under this Section 5.5, Atomic may, at its sole discretion and as your sole and exclusive remedy, either issue a refund of amounts actually received by Atomic for the affected portion of the Tour, less any Non-Refundable Fees, or issue a Future Travel Voucher of equivalent value subject to applicable voucher terms, except to the limited extent that mandatory consumer protection law requires a different remedy.

No additional compensation, price protection, or consequential damages are owed in connection with any correction under this Section 5.5.

5.6 Surcharges and Convenience Fees.

At present, Atomic does not charge a separate credit card convenience fee in addition to the 19% conversion and processing component. If Atomic later adopts any additional surcharge or convenience fee, it will be disclosed clearly in public-facing pricing and at checkout and, unless prohibited by law, will be nonrefundable.

6. What Is Included in the Program Price

6.1 Standard Inclusions.

Unless otherwise stated in the specific final itinerary in the Atomic App or in your Invoice, the Program Price generally covers core group travel services such as accommodations, selected group activities, certain meals, and in-destination transportation during the official Tour window. The exact nature, sequence, and quantity of services are determined by the final itinerary issued by Atomic before departure and as updated in the Atomic App.

Without limiting the foregoing, and subject at all times to Section 6.2 (Service Adjustments) and Sections 8 through 10 (Itineraries and Variations), the Program Price typically includes some or all of the following, as specified in the final itinerary:

• Hotel accommodations with bathrooms, and a single or double bed payout; booking as a “Double/Couple” means your rooms are not shared with people outside your reservation or group, except as expressly indicated and accepted.
• A Tour Director available during the Tour to coordinate logistics and serve as your primary on-tour point of contact;
• Breakfast, lunch, and dinner daily, except where the itinerary states otherwise for specific days or segments;
• Sightseeing tours and excursions led by licensed local guides, as specified in the itinerary;
• Transportation between destination cities as specified in the itinerary (for example, train or bus); Transportation to and from included group activities;
• Airport transfers within the published group arrival and departure windows;
• Entrance fees and museum tickets for specified attractions.
• Walking tours and Tour Director-led sightseeing activities, as specified;
• Cruises, trains, ferries, or similar transportation where indicated as part of the itinerary; and
• Access to support from Atomic representatives abroad during the Tour window.

6.2 Service Adjustments for Missed Inclusions.

Tour operations depend on third-party providers, local conditions, and factors outside Atomic’s control. Accordingly, Atomic may, at any time and without liability, substitute providers, modify the order or timing of activities, or make other reasonable adjustments to the itinerary and inclusions.

If a listed inclusion cannot be provided substantially as described in the final itinerary, Atomic will use reasonable efforts to provide a reasonably comparable alternative or to adjust the schedule. Monetary refunds or credits for missed, modified, or substituted inclusions are not guaranteed and, if offered, are made as a discretionary goodwill adjustment only.

Any discretionary adjustment, alternative service, voucher, or credit that Atomic may provide in connection with a missed or modified inclusion constitutes your sole and exclusive remedy for that service issue, except to the limited extent that non-waivable mandatory law in your jurisdiction requires additional rights.

7. What Is Not Included in the Program Price

7.1 Exclusions.

Unless expressly included in your itinerary or Invoice, the following are not included in the Program Price:

• Room upgrades, single-room supplements, or special rooming requests;
• Optional or third-party excursions or activities not included in the package;
• Beverages except where indicated (for example, alcoholic beverages, specialty coffees, or bottled water when not specified);
• Transportation to or from non-Atomic activities or personal errands;
• Gratuities for Tour Directors, drivers, local guides, and hotel staff, unless specifically included;
• Porterage and baggage handling outside of what is listed as included;
• Airline baggage fees, seat selection fees, or other airline-imposed charges;
• Costs related to airline delays, cancellations, schedule changes, or missed connections;
• Passports, visas, reciprocity fees, and any other fees associated with entry to or exit from a destination;
• Hotel city taxes or tourist taxes payable locally;
• Personal incidentals, including but not limited to minibar charges, room service, laundry, personal communications, and entertainment; and
• Any service, upgrade, or add-on not expressly described as included in writing.

8. Group Travel Model and Private Groups

8.1 Group Consolidation.

Atomic may consolidate multiple groups on a single bus or shared itinerary to maintain reasonable prices and operational efficiency. Groups may vary in age, interests, and background.

8.2 Itinerary Finalization.

Itineraries and travel dates are typically finalized approximately two months prior to departure. Until finalization, minor variations may occur.

8.3 Group Leader Authority.

Prior to itinerary finalization, the Group Leader may request changes to itineraries or travel dates on behalf of the group, subject to Atomic’s approval and any resulting price changes.

8.4 Private Groups.

• In some cases, Atomic may offer private group options for an additional fee, unless the group independently fills a standard bus or program.
• Private groups generally follow the base itinerary without “bus-at-disposal” privileges and may still be consolidated with other groups for optional excursions or activities.
• Private group arrangements must typically be requested before initial enrollment.

9. Itineraries, Variations, Seasonality, and Holidays

9.1 Variations.

Atomic reserves the right to:

• Vary the order of cities or activities;
• Adjust the length of stays in particular locations;
• Substitute hotels with comparable accommodations;
• Utilize alternate airports or transportation providers; and
• Change service providers as needed for operational, safety, or logistical reasons.

9.2 Seasonality and Holidays.

During local, regional, or national holidays, certain facilities (such as museums, shops, or attractions) may be closed or have limited hours. Some inclusions may be unavailable due to seasonality or holiday operations. Atomic may adjust itineraries or substitute alternative activities to reduce inconvenience. Such changes are not deemed “major changes,” do not constitute a breach, and do not trigger any right to compensation or refund beyond any discretionary remedy Atomic may choose to provide.

9.3 Weather and Health Measures.

Weather conditions and public health measures (for example, masking, capacity limitations, timed entries, or restricted food and entertainment options) may affect the experience. Atomic may implement health or safety measures that exceed local requirements. Travelers should consider these potential limitations before booking; such limitations do not entitle you to a refund or price reduction unless expressly provided herein.

10. Enrollment, Names, and Discounts

10.1 Enrollment Cutoff.

Enrollment applications are generally due at least 120 days prior to departure. Enrollment submitted later than this may be treated as Late Enrollment (see Section 11).

10.2 Down Payment.

A nonrefundable, nontransferable Down Payment of 15% of the per-person Program Price is due upon enrollment.

10.3 Names and Travel Documents.

You must provide your full legal name, date of birth, and any other information necessary to match your passport or travel documents. Name change or correction fees may apply if corrections are required after booking, and such fees are Non-Refundable Fees.

10.4 Repeat Traveler Discount.

Atomic may, from time to time, offer repeat Traveler discounts or promotional credits toward future Tours. Any such discounts or credits are:

• Nonrefundable and nontransferable;
• Of no cash value; and
• Subject to any expiration dates and other conditions set forth in the applicable promotion.

11. Late Enrollment

11.1 Late Enrollment and Availability.

Enrollments received within 60 days of departure may be considered Late Enrollments and may be placed on a waitlist while Atomic confirms availability with providers.

11.2 Additional Costs.

The Traveler is responsible for any additional charges incurred as a result of Late Enrollment (for example, higher hotel rates, single room fees, or increased local costs).

12. Passports, Visas, Entry/Exit, and Airline Delays

12.1 Responsibility for Documentation.

You are solely responsible for obtaining and maintaining all required passports, visas, transit visas, vaccinations, and testing for each destination and transit point. Many countries require passports to remain valid for at least three (3) months beyond the date of return. You must provide required passport information by the deadline specified by Atomic.

12.2 Non-U.S. Citizens.

Non-U.S. citizens must consult the appropriate consulates or embassies to determine entry, transit, and exit requirements for each destination.

12.3 Failure to Comply.

Failure to meet applicable entry, exit, or transit requirements is treated as a Traveler cancellation under the Standard Cancellation Policy in Section 19. No additional refunds or compensation are owed for such failure.

12.4 Airlines and Independent Air Travel.

Atomic does not book or sell air transportation. You are entirely responsible for your flights (including schedules, pricing, seating, and baggage) and for complying with airline rules. Atomic is not responsible for airline delays, cancellations, schedule changes, missed connections, or associated costs. Atomic may offer reasonable assistance as a courtesy but does not guarantee re-accommodation, nor does such assistance create any additional financial obligations.

13. Health, Accessibility, and Medical Matters

13.1 Health Disclosures.

You may disclose medical conditions or, alternatively, list specific activities you cannot safely participate in. Atomic may request documentation from a medical practitioner to assess your fitness to travel or participate in certain activities.

13.2 Mobility and Accessibility.

Coaches and some third-party facilities may not be accessible or may have limited accessibility. Accessible rooms, reliable elevator access, and secure storage for mobility or medical devices cannot be guaranteed. You must notify Atomic before booking if you require mobility aids or special accommodations. Travelers requiring personal care must travel with a companion capable of providing such care. Atomic does not provide personal care or medical services.

13.3 Medical Care and Standards.

Atomic does not employ medical personnel. You are responsible for seeking medical attention locally and at your own expense. Medical standards, facilities, and availability abroad may differ significantly from those in your home country, and evacuation may be difficult or delayed.

13.4 Vaccinations and Health Requirements.

You must comply with entry requirements, vaccination mandates, public health rules, and Atomic’s reasonable health and safety protocols. Atomic may implement protocols (including but not limited to testing, masking, or distancing) that exceed local requirements if reasonably necessary for safety.

13.5 ADA and International Standards.

U.S. Americans with Disabilities Act (ADA) standards may not apply abroad. Atomic will make reasonable efforts, where feasible, to assist with accommodation requests but cannot guarantee ADA-equivalent facilities or services.

14. Special Travel Requests (Individual Deviations)

14.1 Fixed Itineraries.

Tour itineraries are group-based and generally fixed. Individual customizations after enrollment are not available, except as expressly agreed in writing by Atomic.

14.2 Stay-Ahead/Stay-Behind and Independent Arrangements.

Atomic may provide advisory support for stay-ahead or stay-behind arrangements, but does not book or manage your flights, personal transportation, or extra lodging outside the official Tour window. All such arrangements and costs are your sole responsibility. Requests must typically be submitted at least 120 days before departure and may be subject to a service fee (for example, $150) plus any additional provider costs.

14.3 Alternate Departure Airports.

Atomic does not select or purchase flights. If you choose alternate departure or return airports or other independent travel arrangements, all associated logistics and costs are your responsibility.

15. Rooming and Assignments

15.1 Room Assignments.

Atomic manages final room assignments considering VIPs, medical needs, group dynamics, hotel requirements, and Group Leader input. Special rooming requests should be made at the time of reservation; Atomic will make reasonable efforts to accommodate but cannot guarantee all requests.

15.2 Minors.

Travelers aged 14–17 must room with their designated adult chaperone unless Atomic approves another arrangement in writing. Family or twin room options may be available; applicable supplements or fees may apply.

16. The Atomic App and Electronic Communications

16.1 Mandatory Use of the Atomic App.

The Atomic App is the primary platform for managing, coordinating, and communicating key aspects of our group travel experiences. As a condition of participation:

• All Travelers are required to download, maintain access to, and actively use the Atomic App on a compatible mobile device for the duration of the Tour.
• The Atomic App and email communications together serve as the primary channels through which Atomic shares hotel assignments, ticket details, itinerary updates, meeting points, and operational messages.
• Failure to download, maintain, or regularly check the Atomic App and the email address on file may cause you to miss critical updates, for which Atomic is not responsible.

You are solely responsible for ensuring that your device is functional, charged, capable of receiving data, and able to access the Atomic App and your email during travel. Atomic is not liable for any loss, delay, or inconvenience arising from your failure to maintain such access, or from temporary service interruptions, network issues, or third-party platform outages beyond Atomic’s reasonable control.

16.2 Paperless Service

Atomic operates as a fully paperless service. Confirmations, tickets, itineraries, and other Tour documents are delivered electronically, including through the Atomic App and email. Printed materials are generally not provided and are not guaranteed, even if occasionally offered as a courtesy.

16.3 Notices and Delivery

Operational notices and communications sent via the Atomic App and to the primary email address on file are deemed delivered when sent, whether or not you actually receive or open them. You are responsible for keeping your contact details current and for checking the Atomic App and your email regularly.

To the fullest extent permitted by law, Atomic’s obligation with respect to notices is satisfied by sending the communication to the contact information you provided. Atomic is not responsible for messages blocked, filtered, delayed, or lost due to spam filters, storage limits, device settings, or third-party service failures.

16.4 SMS and Push Notifications.

By enrolling, you consent to receive SMS, app-based push notifications, and similar operational messages related to your Tour. Marketing SMS or push notifications, if any, will only be sent as permitted by law and may be discontinued at your request.

17. Billing, Invoices, Paperless Billing, and Payment Platforms

17.1 Systems.

Atomic uses two primary systems:

• The official Invoice management system, which reflects the total Program Price, updates, add-ons, and the outstanding balance; and
• Spiffy, which processes scheduled payments and certain stand-alone charges. Due to technical limitations, Spiffy may not always display the complete Invoice total.

17.2 Traveler Responsibilities.

You are responsible for reviewing both your Invoice and your Spiffy schedule to stay current on amounts owed. Extra services, upgrades, fees, and on-trip costs may be billed separately as stand-alone charges and are due upon billing. Itemized receipts for individual components are generally not provided because costs are contracted on a group basis.

17.3 Paperless Billing Terms.

• You agree to receive electronic invoices and notices related to your Atomic account.
• You will not receive paper copies by mail.
• Invoice reminders may be sent to the primary email address you provide; Atomic is not responsible for any delay or failure of electronic delivery.
• You remain obligated to pay all amounts owed by the applicable deadlines, regardless of whether you receive reminders.
• Paperless billing is provided “as is” and without additional warranty; you assume responsibility for monitoring your account.

18. Payments, Payment Plans, Missed Payments, and Non-Refundable Fees

18.1 Payment Deadline.

The Down Payment of 15% of the Program Price is due at enrollment and is nonrefundable and nontransferable. Full payment of the Program Price is due at least thirty (30) days before departure. It is your responsibility to select or adjust any payment plan so that the full balance is paid by that deadline. Failure to do so may result in cancellation without refund under the Standard Cancellation Policy.

18.2 Automatic Payment Plan.

If you choose the Automatic Payment Plan:

• You must select either direct debit from a checking account or a debit card with a Visa or Mastercard logo;
• You must provide a valid email address;
• You must consent to any Automatic Payment Plan terms presented at enrollment;
• You may select a monthly charge date (e.g., 1st–26th of the month) or a biweekly weekday; debits may occur up to three (3) days after the selected date;
• Scheduled amounts may be adjusted if items greater than $20 are added or removed; and
• After the final scheduled payment, any additional items or services are due at the time of purchase.

18.3 Manual Payment Plan.

A Manual Payment Plan may be available and is subject to a nonrefundable fee, typically between $50 and $150 per plan. Manual Payment Plans require you to initiate each payment yourself.

18.4 Missed or Returned Payments.

A nonrefundable fee (currently $80) applies to each returned, declined, or missed payment. Late fees must be paid as a one-time payment and cannot be added to the plan. Atomic may withdraw you from the Automatic Payment Plan after two consecutive returns or declines. If the final payment is returned or declined, you may be withdrawn from the plan and given a short cure period (for example, 72 hours) to pay the remaining balance or forfeit amounts paid as a nonrefundable cancellation.

18.5 Adjustments by Atomic.

Atomic may adjust your payment schedule to align with the payment deadline in Section 18.1 and will provide notice by email.

18.6 Reinstatement of Canceled Payment Plans.

If your payment plan is canceled and you wish to reactivate it, a nonrefundable reinstatement fee (for example, $120) may apply, in addition to any accrued late fees or penalties. Reinstatement is at Atomic’s sole discretion and may require an updated schedule to meet the trip deadline.

18.7 Reinstatement of Discounted Late Fees.

If Atomic discounts, waives, or reduces late fees or penalties as a courtesy, such discount is conditional. In the event of similar payment issues in the future, Atomic may reinstate previously waived amounts, plus new late fees, on the same booking or payment plan.

18.8 Non-Refundable Fees.

The following are expressly Non-Refundable Fees and are nonrefundable and nontransferable under any circumstances except to the limited extent required by mandatory consumer protection law:

• The initial Down Payment (15% of the Program Price);
• Manual Payment Plan fees (for example, $50–$150 per plan);
• Returned or declined payment fees (currently $80 per instance);
• Late payment penalties;
• Reinstatement fees for canceled payment plans;
• Special travel request service charges (including stay-ahead or stay-behind service fees);
• Canceled check or payment processing fees; and
• The 19% conversion and processing component described in Section 5.3.

These fees compensate for administrative processing, third-party commitments, and service execution and are agreed to be reasonable in relation to anticipated damages from cancellations or changes.

19. Cancellations, No-Shows, Replacements, and Refunds

19.1 General Rule

Tours involve significant advance planning, group contracting, and prepayment. Except as expressly stated in this Section 19 and in Section 20 (Force Majeure and COVID-19), all amounts paid to Atomic are nonrefundable. This Section 19 sets out the exclusive terms and remedies that apply to cancellations, no-shows, replacements, and any refunds or credits, subject only to any non-waivable mandatory rights under applicable law.

Cancellation notices are only accepted from the Traveler or Group Leader and are effective when received in writing by Atomic. All required payments must be received on time, and your account must be in good standing, to qualify for any refund or credit described in this Section 19.

19.2 Standard Cancellation Policy (Traveler-Initiated)

Subject to Section 19.1 and any mandatory legal rights that cannot be waived, Atomic’s Standard Cancellation Policy for Traveler-initiated cancellations is as follows:

• 160 or more days before departure: Refund of amounts actually paid to Atomic toward the Program Price, less
  • (i) the 15% nonrefundable Down Payment,
  • (ii) all Non-Refundable Fees, and
  • (iii) a 200 USD cancellation fee.
• 149–110 days before departure: Refund of amounts actually paid to Atomic toward the Program Price, less
  • (i) the 15% nonrefundable Down Payment,
  • (ii) all Non-Refundable Fees, and
  • (iii) a 500 USD cancellation fee.
• 109 days or fewer before departure: No refund. One hundred percent (100%) of amounts paid to Atomic are forfeited.

No additional compensation, damages, or price reductions are owed in connection with a Traveler-initiated cancellation beyond any refund expressly stated above.

19.3 No-Show Policy

A Traveler who fails to appear on the day of departure without written notice received by Atomic at least seven (7) business days in advance is a No-Show. No-Shows are not eligible for any refund, credit, reschedule, or voucher. Atomic will enforce a 100% charge of all amounts paid plus a 500 USD No-Show fee. No additional remedies are available for a No-Show, to the maximum extent permitted by law.

19.4 Cancellation with Replacement Traveler

“Cancellation with replacement” occurs when a Traveler cancels but requests that another eligible individual (a “Replacement Traveler”) take their place on the same Tour, subject to Atomic’s approval and these Terms. Replacement Traveler requests must comply with all required deadlines, documentation, and payment obligations.

• 150 or more days before departure: Refund of amounts actually paid to Atomic toward the Program Price, less (i) the 15% nonrefundable Down Payment and (ii) all Non-Refundable Fees.
• 149–110 days before departure: 30% refund of amounts actually paid to Atomic toward the Program Price, less (i) the 15% nonrefundable Down Payment, (ii) all Non-Refundable Fees, and (iii) a 100 USD substitution fee.
• 109 days or fewer before departure: Replacements are not accepted; the Standard Cancellation Policy in Section 19.2 applies.

The Replacement Traveler’s fully completed enrollment form and any required documents must be submitted together with the original Traveler’s written cancellation notice. Any refund due under this Section 19.4 will be processed only after Atomic has received full payment from the Replacement Traveler. No other compensation or damages are available in connection with a Replacement Traveler arrangement.

19.5 Conditional Cancellation Policy (Discretionary Hardship Cases)

In rare cases, circumstances may arise that do not clearly fall under the Standard Cancellation Policy (for example, certain serious medical events, verified bereavement, or other extraordinary hardship). In such cases, Atomic may, in its sole and absolute discretion, consider a “Conditional Cancellation,” which may involve a full or partial refund, a Future Travel Voucher, a credit, or another remedy.

Any Conditional Cancellation remedy is case-specific, discretionary, and may be conditioned on documentation or other information that Atomic reasonably requests. Conditional Cancellation does not create any right or entitlement to refunds, credits, or vouchers beyond what is expressly granted in writing by Atomic in that particular case, and does not create a precedent for any future case.

19.6 Group Leader Cancellations

If a Group Leader cancels their own participation, the Group Leader must arrange a replacement Group Leader acceptable to Atomic. If no suitable replacement is found, Atomic may, in its discretion, cancel or significantly modify the program for affected Travelers.

In such cases, Atomic may apply the Standard Cancellation Policy, consider the Conditional Cancellation Policy, issue Future Travel Vouchers, or offer alternative Tours. If no suitable alternative option is found, Atomic may, at its discretion, refund amounts paid toward the Program Price, less all Non-Refundable Fees. No additional compensation or damages are owed.

19.7 Refund Processing

Any refund approved under this Section 19 will be processed within a reasonable period (for example, within thirty (30) business days) after Atomic determines your eligibility and refund method. Refunds are normally made to the original payment method where practicable; if that is not possible, refunds may be issued via check, ACH, or another method selected by Atomic. Atomic is not responsible for delays caused by banks, payment processors, or third-party systems.

To the maximum extent permitted by law, any refund, credit, or Future Travel Voucher issued under this Section 19 is your sole and exclusive remedy for the applicable cancellation, no-show, or replacement, and you are not entitled to any additional compensation, damages, or costs.

20. Force Majeure; COVID-19 Cancellations or Modifications

20.1 Force Majeure Events

“Force Majeure” means events or circumstances beyond Atomic’s reasonable control that materially affect the Tour or Atomic’s ability to perform. This includes pandemics or epidemics, public health emergencies, severe weather, natural disasters, war, terrorism, civil unrest, strikes or labor disputes, governmental orders, advisories, or quarantines, sanctions, transportation or infrastructure disruptions, contamination, or other extraordinary events or circumstances that significantly impair or prevent performance.

20.2 Remedy in Force Majeure

If a Tour cannot depart, must be postponed, or is significantly interrupted due to Force Majeure, Atomic’s primary and usually exclusive remedy is to issue a Future Travel Voucher equal to amounts actually paid to Atomic for the affected Tour, prorated in the case of interrupted Tours, subject to applicable voucher terms.

Issuance of a Future Travel Voucher in a Force Majeure situation is not a breach of contract or a failure to perform. Except to the limited extent required by non-waivable mandatory law, no additional cash refund, price reduction, or compensation is owed.

20.3 COVID-19 and Public Health-Related Modifications

Even if travel is technically possible, Atomic may cancel, postpone, reroute, or otherwise modify a Tour in its reasonable discretion due to health or safety concerns, including COVID-19 or other public health events, supplier availability, or to preserve the overall feasibility and quality of the trip.

In such situations, Atomic may, at its discretion, issue a Future Travel Voucher equal to amounts actually paid to Atomic for the affected Tour, prorated if the Tour is cut short, and may propose alternative itineraries or dates. No additional cash refund is owed unless required by non-waivable mandatory law.

20.4 Mandatory Law

To the extent required by non-waivable mandatory law in your jurisdiction, different or additional remedies may apply. Nothing in this Section 20 is intended to limit statutory rights that you cannot waive under applicable law. This Section 20 is intended to be enforced to the maximum extent permitted.

21. Conduct, Rules of the Road, and Dismissal

21.1 Prohibited Conduct.

To protect the safety and enjoyment of all participants, the following conduct is prohibited:

• Abuse, bullying, harassment, threats, or violence;
• Intoxication or excessive alcohol consumption;
• Possession, use, or distribution of illegal substances;
• Possession of dangerous items or weapons in violation of law or provider policies;
• Vandalism, theft, or damage to property;
• Behavior that substantially interferes with the itinerary, disrupts the group, or endangers others; and
• Any violation of local laws, hotel policies, or Atomic’s rules communicated by the Tour Director or Group Leader.

21.2 Participation Requirements.

• All scheduled activities are mandatory unless the Tour Director expressly excuses you.
• During designated free time, you must follow any sign-out or disclosure procedures described in the Atomic App or by the Tour Director and return at the designated time.
• Smoking or vaping is prohibited on coaches and in any other locations where it is locally restricted.
• Travelers under 18 may not consume alcohol.
• Travelers who are 18 or older (or older, if local law requires) may consume beer or wine in moderation, subject to local law and the discretion of the Tour Director and Group Leader.

21.3 Hotel Incidentals and Damages.

You are responsible for your hotel incidentals and for any damage you cause to hotel rooms, buses, or other property. If you observe pre-existing damage, you must promptly notify the Tour Director upon arrival.

21.4 Conduct Enforcement and Decision Authority.

The Tour Director may issue verbal or written warnings for violations of these Terms. In cases of significant disruption, misconduct, safety concerns, or any behavior deemed to endanger others or substantially interfere with the experience, Atomic may immediately terminate your participation in the Tour. Decisions to remove a Traveler from the Tour are final and not subject to on-tour appeal.

21.5 Early Return Costs and No Refund.

If you are dismissed from the Tour, you are solely responsible for all associated costs, including but not limited to return travel, alternate lodging, and incidental expenses. No refunds, credits, or other compensation are owed for unused services if you are removed for conduct-related reasons.

22. Traveler Responsibilities

22.1 General Responsibilities.

In addition to any specific obligations set forth elsewhere in these Terms, you agree to:

• Maintain valid travel documentation (passport, visas, etc.);
• Comply with local laws, advisories, and regulations;
• Follow the instructions provided via the Atomic App and by the Tour Director and Group Leader;
• Participate in scheduled activities and be punctual;
• Treat fellow Travelers, staff, and Third-Party Providers with courtesy and respect;
• Promptly report illness, safety concerns, or emergencies to the Tour Director; and
• Comply with all Conduct Policy requirements and health and safety protocols.

23. Security, Safety, and Prohibited Items

23.1 Travel Risks and Advisories.

Security conditions and government advisories can change quickly. Travel advisories, government warnings, and events around the world may require changes to accommodations, itineraries, or, in some cases, Tour cancellation. By booking with Atomic, you acknowledge and accept the inherent risks involved in international and group travel, including travel to locations that may experience security challenges, and you agree that you are ultimately responsible for your own travel decisions.

23.2 Prohibited Items.

For safety reasons:

• Firearms and weapons are prohibited, except where their possession is legally required and fully disclosed to Atomic in advance;
• Illegal substances are strictly prohibited; and
• Any item reasonably considered hazardous may be restricted or prohibited at the Tour Director’s discretion.

23.3 Seat Belts and Safety Equipment.

Where seat belts or other safety equipment are provided on coaches or other vehicles, you must use them. Failure to use available safety equipment may limit or bar any claim for related injuries to the maximum extent permitted by law.

24. Third-Party Providers; Responsibility; Disclaimers

24.1 Role of Atomic.

Atomic acts as a tour operator and coordinator, arranging services provided by independent Third-Party Providers such as hotels, carriers, local operators, restaurants, and activity providers.

24.2 Independent Contractors.

Third-Party Providers are independent contractors and are not employees, agents, or partners of Atomic. Their services are subject to their own terms and local laws. Atomic does not control and is not responsible for the acts or omissions of Third-Party Providers.

24.3 No Air Sales.

Atomic does not sell or book air transportation. You are solely responsible for your flights and all related costs and arrangements, including compliance with airline rules and policies. References to airlines in any materials are informational only.

24.4 Substitutions and Variations.

Atomic may substitute vendors, change providers, adjust routes, modify the order or timing of activities, or make other reasonable operational changes at any time due to availability, safety considerations, local conditions, or logistical requirements. Atomic will use reasonable efforts to deliver an overall experience of substantially similar quality, but specific hotels, restaurants, vehicles, guides, or individual activities are not guaranteed.

Variations, substitutions, or changes of the type described in this Section 24.4 do not entitle you to a refund, credit, discount, or other compensation, except to the limited extent that Atomic voluntarily offers a discretionary remedy. Any such discretionary remedy constitutes your sole and exclusive remedy, and Atomic has no further liability, including for incidental, indirect, or consequential damages, to the fullest extent permitted by law.

25. Assumption of Risk; Additional Risks; Indemnity

25.1 Assumption of Risk.

By enrolling in and participating in a Tour, you acknowledge and accept the risks associated with travel generally, and group travel in particular, including but not limited to:

• Travel in urban and rural locations with differing standards of infrastructure, sanitation, and safety;
• Use of various modes of transportation (for example, buses, trains, ferries, and walking);
• Natural environments and weather conditions;
• Risks from food, water, and animals;
• Possibility of theft, loss, or damage to personal property;
• Disease transmission, public health events, and limited medical facilities or care;
• Evacuation challenges and delays; and
• Unpredictable governmental actions, strikes, or unrest.

You voluntarily assume these risks for yourself and any minor Traveler for whom you are legally responsible.

25.2 Indemnity.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Atomic and its owners, officers, directors, employees, and agents from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of:

• Your breach of these Terms;
• Your misconduct, negligence, or intentional acts; or
• Your violation of any applicable law, rule, or regulation.

26. Travel Insurance

26.1 Recommendation.

Atomic strongly recommends that you purchase comprehensive travel insurance that covers at least:

• Trip cancellation and interruption;
• Emergency medical expenses and injury;
• Medical evacuation and repatriation;
• Baggage loss and delay; and
• Disruptions related to pandemics or public health events.

26.2 Choice of Provider.

You are solely responsible for selecting an insurance provider and ensuring that your coverage is adequate for your needs. Atomic may receive commissions or compensation if you purchase insurance through a recommended partner.

26.3 Uninsured Losses.

Atomic is not responsible for any losses, costs, or expenses you incur as a result of your failure to obtain adequate travel insurance.

27. Website and App Use; Intellectual Property

27.1 Limited License.

Atomic grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site and Atomic App solely for personal, noncommercial purposes related to booking and participating in Tours.

27.2 Prohibited Uses.

You may not:

• Scrape, data mine, or systematically access the Site or Atomic App for competitive purposes;
• Reverse engineer, decompile, or attempt to derive source code;
• Test or attempt to breach security measures;
• Interfere with or disrupt the operation of the Site or Atomic App;
• Upload or transmit unlawful, infringing, defamatory, or harmful content;
• Post false, misleading, or fraudulent reviews or information; or
• Attempt to bypass access controls, payment requirements, or other technical safeguards.

27.3 Ownership.

Atomic owns all rights, title, and interest in the Site and Atomic App, including text, images, logos, trademarks, and other content, except as otherwise noted. All rights not expressly granted to you are reserved.

27.4 User-Generated Content (UGC).

If you provide photos, videos, testimonials, reviews, or other content to Atomic or share such content using Atomic’s branded hashtags or channels, you grant Atomic a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute such content for marketing and service purposes, subject to applicable privacy and publicity laws and any opt-out mechanisms we may provide.

28. Privacy and Cookies

28.1 Privacy Policy.

Atomic’s Privacy Policy governs how we collect, use, and protect personal data. The Privacy Policy is incorporated by reference into these Terms. By using the Site/App or enrolling in a Tour, you acknowledge that you have had an opportunity to review the Privacy Policy.

28.2 Summary of Data Practices.

Without limiting the Privacy Policy, Atomic may collect and process:

• Contact details and enrollment information;
• Communications and preferences;
• Device and usage data from the Site/App;
• Payment-related information provided to third-party processors; and
• Data necessary for operations, customer service, safety, and legal compliance.

28.3 Data Sharing and Transfers.

Atomic may share data with affiliates, insurers, claims handlers, vendors, and service providers as necessary to perform services and comply with law, including cross-border transfers where permitted. Where required, Atomic will implement appropriate safeguards (such as contractual clauses or equivalent measures).

28.4 Marketing Communications.

Marketing emails, SMS messages, and similar communications will be sent only as permitted by law and based on appropriate consent where required. You may unsubscribe or opt out at any time using the mechanisms provided.

28.5 EU/UK and Other Regional Rights.

To the extent Atomic markets to or processes data of individuals in the EU/UK or other jurisdictions with enhanced data rights, those individuals may have additional rights (for example, access, rectification, erasure, or objection) as described in the Privacy Policy. Nothing in these Terms is intended to limit any non-waivable privacy rights under applicable law.

29. Warranty Disclaimers

29.1 Site and App “As Is.”

The Site and Atomic App are provided “as is” and “as available,” without any warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, Atomic disclaims all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

29.2 No Guarantee of Uninterrupted Service.

Atomic does not warrant that the Site or Atomic App will be uninterrupted, secure, or error-free, or that defects will be corrected. Use of the Site and App is at your own risk.

29.3 Third-Party Services.

Any services provided by Third-Party Providers are subject to their own terms and conditions. Atomic does not guarantee the performance or suitability of any Third-Party Provider and is not responsible for their acts or omissions.

30. Limitation of Liability; Aggregate Damages Cap

30.1 Exclusion of Certain Damages.

To the maximum extent permitted by law, Atomic shall not be liable for:

• Indirect, special, incidental, consequential, punitive, or exemplary damages;
• Lost profits, lost revenue, loss of goodwill, loss of data, or business interruption; or
• Any damages arising from events or causes beyond Atomic’s reasonable control, including the acts or omissions of Third-Party Providers, airlines, or governmental authorities.

30.2 Aggregate Cap.

To the maximum extent permitted by law, Atomic’s total aggregate liability for all claims, causes of action, and disputes arising out of or relating to:

• These Terms;
• The Site or Atomic App; and/or
• Any Tour or services provided in connection with a Tour,

shall not exceed one hundred fifty U.S. dollars (US $150) per Traveler in the aggregate, regardless of the theory of liability (whether based in contract, tort, statute, or otherwise).

30.3 Refunds and Business Policies.

Any refunds, credits, vouchers, or other remedies that Atomic chooses to offer under these Terms or its internal business policies are voluntary contractual remedies and not separate categories of damages. To the fullest extent permitted by law, in any lawsuit, arbitration, or other legal proceeding, the aggregate cap in Section 30.2 applies to all monetary relief potentially recoverable from Atomic, including any alleged failure to provide a refund or credit, except to the extent a non-waivable law in your jurisdiction requires a different result.

31. Governing Law; Mediation; Dispute Resolution; Class and Jury Waivers

31.1 Governing Law.

These Terms and any dispute arising out of or relating to them, the Site/App, or any Tour shall be governed by the laws of the State of Nevada, without regard to conflict-of-law rules that might direct the application of another jurisdiction’s laws.

31.2 Mandatory Mediation as a Condition Precedent.

As a condition precedent to any lawsuit or other formal proceeding (other than small claims court or emergency injunctive relief as described below), you and Atomic agree to attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Site/App, or any Tour through mediation:

• Either party may initiate mediation by providing written notice of the dispute to the other party;
• The parties will select a mutually agreeable mediator (for example, through JAMS, AAA, or a local mediation service);
• Mediation shall occur in Las Vegas, Nevada, or virtually, within approximately forty-five (45) days of the initiating notice, unless otherwise agreed; and
• Each party will bear its own attorneys’ fees and share mediator and administrative fees equally, unless otherwise agreed in writing.

31.3 Litigation in Nevada Courts (After Mediation).

If the dispute is not resolved in mediation, you and Atomic agree that:

• Any lawsuit or proceeding (other than qualifying small claims actions under Section 31.5) shall be brought exclusively in the state or federal courts located in Clark County, Nevada;
• Each party irrevocably submits to the personal jurisdiction of such courts; and
• Venue is proper in such courts for all such disputes.

31.4 Injunctive Relief for Intellectual Property or Confidential Information.

Either party may seek temporary, preliminary, or emergency injunctive relief in court to protect its intellectual property rights or confidential information without first engaging in mediation if necessary to prevent irreparable harm. However, the parties will still make good-faith efforts to resolve the underlying dispute through mediation.

31.5 Small Claims Court Option.

Either party may bring an individual claim in small claims court in Clark County, Nevada, if the claim is within that court’s jurisdictional limits. Such small claims actions are not subject to the formal mediation requirement in Section 31.2, though the parties are encouraged to attempt resolution informally.

31.6 Class Action Waiver.

To the maximum extent permitted by law, you and Atomic agree that:

• Any dispute shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or similar proceeding; and
• The court may not consolidate or join the claims of multiple parties or otherwise preside over any form of a representative or class proceeding against Atomic.

If this Class Action Waiver is found unenforceable with respect to a particular claim or request for relief, then that portion of the claim or request for relief shall be severed and brought in an individual proceeding, and the remaining provisions of this Section 31 shall remain in full force and effect.

31.7 Jury Trial Waiver.

To the maximum extent permitted by law, you and Atomic knowingly, voluntarily, and irrevocably waive any right to a trial by jury in any lawsuit or proceeding arising out of or relating to these Terms, the Site/App, or any Tour. Any such dispute shall be resolved by a judge sitting without a jury.

32. Assignment; No Third-Party Beneficiaries

32.1 Assignment by Traveler.

You may not assign or transfer your booking, your rights under these Terms, or your interest in a Tour to any other person without Atomic’s prior written consent, except as expressly permitted for a Replacement Traveler under Section 19.

32.2 Assignment by Atomic.

Atomic may assign these Terms and any of its rights or obligations hereunder, in whole or in part, to any affiliate or in connection with a merger, sale, reorganization, or other business transaction.

32.3 No Third-Party Beneficiaries.

Except as expressly stated, these Terms do not confer any rights or remedies on any third party. For avoidance of doubt, Travelers who are parties to a single Group or family booking are not third-party beneficiaries of one another’s separate dealings with Atomic.

33. Notices

33.1 Notices to Travelers.

Notices to Travelers will be provided via the Atomic App and/or by email to the primary email address on file and are deemed delivered when sent.

33.2 Notices to Atomic.

Notices to Atomic under these Terms must be sent by email and by postal mail to:

34. Severability; Waiver; Entire Agreement; Headings; Survival

34.1 Severability.

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Where possible, an invalid provision shall be replaced with a valid provision that most closely reflects the parties’ original intent.

34.2 No Waiver.

No failure or delay by Atomic in exercising any right, power, or remedy under these Terms shall operate as a waiver of such right, power, or remedy. Any waiver must be in writing and signed by an authorized representative of Atomic.

34.3 Entire Agreement.

These Terms, together with any Booking Conditions, policies, addenda, and Exhibits referenced herein or incorporated by reference, constitute the entire agreement between you and Atomic regarding the subject matter and supersede all prior or contemporaneous written or oral understandings, representations, or promotional materials.

34.4 Headings.

Section and paragraph headings are for convenience only and do not affect the interpretation of these Terms.

34.5 Survival.

Provisions that by their nature should survive termination or completion of the Tour shall survive, including but not limited to: payment obligations; Non-Refundable Fees; indemnity; intellectual property; warranty disclaimers; limitation of liability; governing law and dispute resolution; notices; and any other provisions expressly stated to survive.

Exhibit A: Conduct Policy (“Rules of the Road”)

Purpose.

This Conduct Policy promotes safety, respect, and an enjoyable experience for all participants and service providers on Atomic Tours. This Exhibit A forms part of, and is incorporated into, the Atomic Terms of Service and Booking Conditions (the “Terms”). In the event of any conflict or inconsistency between this Exhibit A and the Terms, the Terms shall control.

Core Standards.

• Respect. Treat fellow Travelers, staff, and Third-Party Providers with courtesy and respect at all times.
• Compliance. Follow the Tour Director’s and Group Leader’s reasonable instructions and comply with all local laws and regulations.
• Safety. Prioritize safety, follow safety briefings, and comply with equipment requirements and posted rules.

Prohibited Behaviors.

The following behaviors are strictly prohibited:

• Abuse, bullying, harassment, threats, or violence;
• Intoxication, excessive alcohol consumption, or alcohol use by minors;
• Possession, use, or distribution of illegal substances or misuse of prescription drugs;
• Possession of dangerous items or weapons in violation of law or policy;
• Vandalism, theft, or damage to property;
• Disruptive conduct that interferes with the itinerary or others’ enjoyment;
• Violation of quiet hours, hotel rules, or local regulations.

Atomic and the Tour Director may report suspected unlawful conduct to local authorities where appropriate.

Alcohol and Smoking.

• Travelers under 18: no alcohol consumption.
• Travelers 18 or older (or older, if local law requires): may consume beer or wine only, in moderation, subject to local law and the discretion of the Tour Director and Group Leader. Intoxication is prohibited.
• Smoking and vaping are prohibited on coaches and anywhere locally restricted.

Attendance and Punctuality.

• All scheduled activities are mandatory unless the Tour Director excuses you.
• You must be on time. Repeated tardiness may result in removal from certain activities or, in serious or repeated cases, dismissal from the Tour.

Free Time and Leave Procedures.

• During free time, you must notify the Tour Director of your plans where required and follow any sign-out procedures in the Atomic App.
• You must return by the designated times.

Property and Incidentals.

• You are responsible for hotel incidentals and for any damages you cause.
• If you observe prior damage, you must immediately inform the Tour Director.
• Where responsibility for damage cannot reasonably be attributed to a single Traveler, Atomic may allocate costs in good faith among the Travelers assigned to the relevant room or area, and each such Traveler agrees to pay their allocated share.

Enforcement.

• The Tour Director may issue verbal or written warnings, impose reasonable conditions, or remove a Traveler from specific activities for minor infractions.
• Atomic may dismiss a Traveler from the Tour for serious violations or safety concerns, without refund, at the Traveler’s expense for any return travel. Dismissal from the Tour is not a ground for any refund, credit, voucher, or price reduction of any kind.

Remedies and Costs.

• No refunds are provided for missed portions of the Tour due to conduct violations.
• Atomic may seek reimbursement for damages, fines, penalties, or other costs incurred as a result of a Traveler’s conduct, including reasonable collection costs and attorneys’ fees to the extent permitted by law.

Reporting.

• Travelers are encouraged to report safety concerns, illness, or misconduct promptly to the Tour Director or via the Atomic App.

This Exhibit A is intended to summarize and supplement conduct-related provisions of the Terms and does not expand Atomic’s obligations or liability beyond what is expressly provided in the Terms.

Exhibit B: Standard Cancellation Schedules and Fees (Summary)

Scope and Relationship to Terms.

This Exhibit B summarizes, for convenience only, key elements of Section 19 of the Terms. It does not expand, limit, or modify the rights, obligations, or remedies set forth in Section 19. In the event of any conflict or ambiguity, Section 19 of the Terms governs.

Standard Traveler-Initiated Cancellation.

• 160+ days prior to departure: Refund of amounts actually paid, less (i) the 15% Down Payment, (ii) all Non-Refundable Fees, and (iii) a $200 cancellation fee.
• 149–110 days prior: Refund of amounts actually paid, less (i) the 15% Down Payment, (ii) all Non-Refundable Fees, and (iii) a $500 cancellation fee.
• 109 days or fewer: No refund; 100% forfeiture of amounts paid.

No-Show.

• 100% charge plus a $500 No-Show Fee; no refund, credit, or reschedule. No additional remedies, including price reductions, alternative departures, or other compensation, are available for a No-Show.

Replacement Traveler.

• 150+ days prior: Refund of amounts actually paid, less the 15% Down Payment and all Non-Refundable Fees.
• 149–110 days prior: 30% refund of amounts actually paid, less (i) the 15% Down Payment, (ii) all Non-Refundable Fees, and (iii) a $100 substitution fee.
• 109 days or fewer: Replacements not accepted; the Standard Cancellation Policy applies.

Conditional Cancellation.

• In rare circumstances not clearly governed by the Standard Cancellation Policy, Atomic may, in its sole discretion, offer a Conditional Cancellation remedy, which may include partial or full refund or a Future Travel Voucher, based on the reason, timing, and documentation. Any such remedy is discretionary, case-specific, and does not create any ongoing entitlement or precedent.

Processing.

• Approved refunds are processed within a reasonable timeframe after eligibility is confirmed, typically via the original payment method if available, consistent with Section 19 of the Terms.

This Exhibit B is a convenience summary only and does not confer any rights beyond those set forth in Section 19 of the Terms.

Exhibit C: Payment Plan Terms and Fees (Summary)

Scope and Relationship to Terms.

This Exhibit C provides a summary of certain payment and fee provisions in Sections 16–18 of the Terms. It is for convenience only and does not alter your obligation to pay the full Program Price by the deadlines in the Terms, regardless of the status of any payment plan. To the extent of any conflict or ambiguity, the Terms control.

Down Payment.

• 15% of the per-person Program Price, due upon enrollment; nonrefundable and nontransferable.

Payment Deadline.

• Full balance is due at least thirty (30) days prior to departure; any payment plan must be structured or adjusted to ensure the full balance is received by this deadline. Failure to do so may result in cancellation under the applicable cancellation policy without refund.

Automatic Payment Plan.

• Methods: ACH or debit card with Visa/Mastercard logo.
• Schedule: Monthly (1st–26th) or biweekly weekday; debits may occur up to three (3) days after the scheduled date.
• Adjustments: Scheduled amounts may change if items greater than $20 are added or removed. After the final scheduled payment, any new items are due at the time of purchase.

Manual Payment Plan.

• Subject to a nonrefundable fee, typically $50–$150 per plan. Manual Payment Plans require you to initiate each payment.

Late/Returned Payments.

• $80 nonrefundable fee per returned, declined, or missed payment; late fees must be paid as a one-time payment and cannot be added to the plan.
• Two consecutive declines may result in removal from the plan and possible cancellation if any outstanding balance is not cured within the stated timeframe.

Adjustments and Reinstatement.

• Atomic may revise payment schedules to ensure compliance with payment deadlines (notice via email).
• Reinstatement of a canceled payment plan may be subject to a nonrefundable reinstatement fee (for example, $120), plus accrued penalties; an updated schedule may be required.
• Any courtesy waivers or reductions of fees are conditional. In the event of repeated payment issues, Atomic may reinstate previously waived amounts, plus new fees, which then become due.

Chargebacks.

• Atomic may suspend services, deny travel, and charge fees associated with chargebacks or bank disputes.
• Unfounded or bad-faith disputes are treated as a material breach of the Terms, and Atomic may pursue recovery of all amounts owed, together with reasonable collection costs and attorneys’ fees to the extent permitted by law.

To the extent permitted by applicable law, all fees described in this Exhibit C are “Non-Refundable Fees” as defined in Section 18 of the Terms and are nonrefundable and nontransferable except where mandatory consumer protection law requires otherwise.

Exhibit D: Health and Accessibility Guide (Summary)

Scope and Nature of Guidance.

This Exhibit D is informational in nature and summarizes certain health and accessibility concepts addressed in the Terms. It does not constitute medical advice, does not guarantee the provision of any particular accommodation or service, and does not expand Atomic’s obligations or liability beyond what is set forth in the Terms.

Health Disclosures.

• Travelers should provide relevant medical information or identify activities they cannot safely participate in. Atomic may request a practitioner’s assessment or documentation to evaluate fitness to travel or participate in specific activities.
• Travelers are solely responsible for consulting their own medical providers regarding whether travel and particular activities are appropriate for them.

Mobility and Devices.

• Coaches and some accommodations may not be fully accessible. Accessible rooms, reliable elevator access, and secure storage for mobility or medical devices cannot be guaranteed.
• Travelers requiring personal assistance must arrange for a companion capable of providing such assistance.

Medical Services.

• Atomic does not provide medical care and does not employ medical personnel. Travelers must seek local care at their own expense, recognizing that standards, availability, and practices may differ from those in their home country and that evacuation may be difficult or delayed.

Vaccinations and Entry Requirements.

• Travelers must comply with all destination health requirements, including vaccinations, testing, and related entry conditions where required.
• Atomic may adopt enhanced health or safety measures where reasonably necessary, which may exceed local requirements.

ADA and International Standards.

• United States Americans with Disabilities Act (ADA) standards may not apply abroad. Atomic will make reasonable efforts, where feasible, to assist with accommodation requests but cannot guarantee ADA-equivalent facilities or services.
• No refund, credit, or price reduction is owed where requested accommodations are unavailable.

On-Tour Practices.

• Travelers should promptly inform the Tour Director of health concerns, carry necessary medications, and maintain adequate travel insurance.

Nothing in this Exhibit D creates any right to medical or accessibility services beyond those expressly assumed in the Terms, nor does it alter any disclaimer or limitation of liability in the Terms.

Exhibit E: Insurance Guidance and Recommended Minimums (Non-Binding Guidance)

Scope and Nature of Guidance.

This Exhibit E is for informational purposes only and is non-binding. It does not constitute insurance, legal, or financial advice, and does not alter the cancellation rules, refund policies, limitations of liability, or other provisions in the Terms.

Recommended Minimum Coverage.

While not required, Atomic recommends that Travelers consider obtaining coverage at or above the following illustrative levels (subject to discussion with a licensed insurance professional):

• Emergency medical coverage sufficient for treatment abroad (for example, at least $100,000);
• Medical evacuation and repatriation coverage (for example, at least $250,000);
• Trip cancellation and interruption coverage proportionate to the Program Price and any independent airfare;
• Baggage loss and delay coverage reflecting the value of personal items; and
• Coverage for disruptions related to pandemics or other public health events.

No Insurance Advice; Choice of Provider.

• This Exhibit is informational only and does not constitute insurance, legal, or financial advice.
• Travelers should consult with a licensed insurance agent or broker to determine appropriate coverage for their specific situation.
• Travelers are solely responsible for selecting an insurance provider and ensuring that any policy purchased is adequate for their needs.
• Atomic may receive commissions or other compensation if insurance is purchased through or via a recommended partner, but Atomic does not underwrite, administer, or adjust any insurance product.

Uninsured Losses and Claims.

• If a Traveler chooses not to obtain travel insurance, or if their coverage is insufficient, excluded, or denied, the Traveler agrees that they are solely responsible for all resulting losses, costs, and expenses.
• Atomic does not guarantee that any particular claim will be covered, approved, or paid by any insurer, and is not responsible for the acts, omissions, or decisions of any insurer, broker, or claims handler.

This Exhibit E does not modify any limitation of liability, cancellation or refund provision, or other business policy stated in the Terms. In all cases, the Terms control.
