General Terms and Conditions

These Booking Conditions are valid for all Atomic Trip tours departing after October 1, 2023.
All tours are operated outside of the U.S. by (M&S Sublets & Services LLC) and are referred to herein as “Atomic” or “Atomic Trips.”

Your agreement is with Atomic Trips, and a contract is formed when you make a reservation with us that we accept. Enrollment in and payment for a trip shall constitute acceptance by the guest of the terms and conditions in this document. These cannot be varied except in writing by an officer of Atomic Trips.

All contracts with Atomic are made subject to the terms of these booking conditions.
We reserve the right to change these booking conditions at any time prior to you making a booking.

The invalidity of any provisions herein shall not affect the validity of any other provisions. The agreement shall be construed as though the invalid provision was not contained herein and was replaced with an enforceable provision as similar as possible to the original provision.
Should any conflict arise between these booking conditions and those contained within our brochures, these booking conditions shall prevail.

Departure Date

The departure date is the date indicated on the booking confirmation.

Security

Security is a major concern to all of us and the situation globally is constantly changing. Events around the world, coupled with the “Travel Advisories” put out by various governments, may at times necessitate changes to the accommodations and itinerary or even trip cancellation. You must accept these risks involved in travel to any country that may experience security difficulties and accept responsibility for your own travel decisions.

Travel Insurance

Travel insurance is highly recommended for all guests covering all applicable dates of travel with Atomic Trips. This insurance should cover: trip interruption, personal injury, medical expenses, evacuation and repatriation cover including during pandemic events. The choice of insurer is yours. The availability of travel insurance and extent of cover is constantly changing, please refer to our website [www.atomictrips.com] for the most up to date information or talk to your reservation agent. Atomic Trips or its affiliates may receive a commission for introducing you to a travel insurance provider.

Atomic cannot be held responsible for your failure to obtain insurance which is appropriate, and we recommend you purchase your insurance at or soon after booking your trip. Atomic will not be held liable for any costs incurred by the guest resulting from their failure to obtain adequate travel insurance.

WHAT’S INCLUDED IN THE PROGRAM PRICE?

The above apply to all tours unless otherwise noted on the tour itinerary. If we everfail to provide you with any of the above, we will refund you its value upon your return from the tour.

GROUP TRAVEL

How does group travel work?

We believe that everyone should have the opportunity to travel, which means we do everything we can to keep our prices the lowest in the industry without sacrificing quality. One of the ways we do that is by combining groups to fill a tour bus so that all travelers help cover the costs of the bus, the Tour Director, local guides, etc. Consolidating groups also allows travelers to meet each other and experience the adventure together, although groups may not be of the same age level.

Therefore, in order for everyone to travel for the lowest price possible, group travel requires some flexibility and room for error. Once a program is booked, Atomic’s Standard Cancellation Policy applies. Your final tour itinerary and travel dates will be confirmed approximately two months prior to departure. In enrolling on a group travel program, you are also making the decision to travel with The Group Leader who retains
the ability to change the requested tour itinerary or travel dates on your and your group’s behalf.

Anything else I need to know about my itinerary?

Based on your travel dates, there may be times when it becomes necessary to modify your itinerary. Sometimes this involves changing the order in which cities are visited, altering your length of stay in a city or country, or using an alternate airport.
On certain days, especially holidays, some tour inclusions may be unavailable. In such cases, we will substitute different inclusions or provide an alternative happening.

PRIVATE GROUPS

What if my group wants to travel on our own without being consolidated?

If you want the privacy of your own tour bus and Tour Director, you can choose to travel as a private group. This option is available for an additional fee, which varies based on the final number of paying travelers. If your group fills a standard-size tour bus, the private group option is free. The itinerary may not be modified while on tour (i.e. you do not have the tour bus at your disposal); however you are able to make certain tour modifications prior to the tour departure. Although your base itinerary will include only your group, you may be consolidated with others during optional excursions. Also, due to flight and hotel availability, we require the same departure date flexibility as described above. Please contact Atomic prior to your first enrollment if you would like to be a private group.

ENROLLMENT

Atomic incurs substantial non-recoverable staff costs and other expenses from the time of initial enrollment in processing traveler applications, beginning the planning and preparation needed for your and your group’s tour program, and eligibility for discounts on other Atomic programs. 15% of the per person rate is considered non-refundable, non-transferable. All traveler enrollment applications must be received by Atomic by at least 120 days prior to departure.

What is the cost of a name correction?

Travelers must provide their complete first, middle, and last names and dates of birth as they appear (or will appear) on their passports. Travelers who have not yet applied for a passport should provide their full name and date of birth as they appear on their birth certificate. A fee of up to $200 may be collected for name correction.

Are there discounts for repeat travelers?

After travel is completed on their first tour, repeat travelers will receive a $100 repeat traveler discount off of the program fee for future tours. Travelers who cancel their tour prior to traveling are not eligible for a repeat traveler discount. The repeat traveler discount is nonrefundable, non-transferable, and has no cash value.

Can children under 14 go on tour?

We do not allow children under the age of 14 to travel with us. Travelers ages 14-17 must have an adult chaperone other than the Group Leader and will have to room with that chaperone. Travelers may choose to stay in a family room (a room with two twin beds and a cot) or in a twin (a room with two beds). Applicable fees will apply.

LATE ENROLLMENTS

Can a traveler enroll after 110 days prior to departure?

Yes. A traveler may submit a late enrollment request 60 days or fewer prior to departure. The traveler might be placed on a waiting list while we check bus, flight, and hotel availability. The Traveler is responsible for any additional charges that may apply.

PASSPORTS, VISAS, OTHER TRAVEL DOCUMENTS & ENTRY REQUIREMENTS

Who is responsible for obtaining a traveler’s passport, visas, and other travel documents and for complying with a destination’s entry requirements?

Each traveler is solely responsible for obtaining prior to departure a valid passport, applicable visas, and any other required travel documents, as well as verifying and satisfying the entry and exit requirements necessary for each destination of the tour itinerary.

This may include required medical documents, testing, or proof of vaccinations (including any requirement to provide proof of full and up to date COVID-19 vaccination). All U.S. passports must be valid for at least three months following the tour’s return date, and travelers will need to provide passport information to Atomic by 60 days prior to departure.

Non-U.S. citizens will need to contact the embassy or consulate of their destination countries to ensure they meet specific entry requirements. Remember to check your itinerary carefully for all countries that will be visited (including countries visited in transit). Visit the U.S. Department of State’s travel website at www.travel.state.gov for more information.

If a traveler is unable to obtain these travel documents or meet any applicable entry or exit requirement, Atomic’s Standard Cancellation Policy will apply and travelers will be solely responsible for any incurred expenses.

What happens if my flight is delayed?

Atomic Trips is not responsible for airline schedule changes or mechanical, weather, or capacity-related flight delays. If your flight is delayed or canceled, you should contact your Group Leader as soon as possible and alert them of the change in your arrival. Atomic Trips does not guarantee your assimilation onto the tour, but will however, make reasonable attempts to assist you. Any cost associated with a delayed flight is the sole responsibility of the traveler.

Health, reduced mobility, medical conditions/disabilities and assistance when traveling. If you suffer from reduced mobility or have any other disability or medical condition which may affect your vacation arrangements, you have the option to:

  1. Provide us with full details of your medical condition;
  2. Or if you prefer to maintain your personal privacy simply share with our team any activities you may be unable to participate in; before booking so that we can advise you if we can accommodate your request and provide you with precise information as to the suitability of the vacation taking into account your needs. We will not be responsible for any damage, injury, death or loss of any kind resulting from your failure to fully disclose relevant mobility, disability or medical information. In some cases we may request you to provide an assessment of your condition from a qualified medical practitioner.

Reduced mobility of course means different things to different individuals as we fully appreciate that individual capabilities, restrictions and requirements are likely to vary considerably. When we refer to reduced mobility, this means any material reduction in mobility whether this is permanent or temporary and whether caused by age or by physical or mental disability or impairment or other cause of disability. We rely on your assessment of your own ability to participate in a trip. Please also promptly inform us in writing in the event that any material change in your mobility, any other disability or medical condition occurs after your booking has been confirmed.

Atomic does not provide personal devices (such as wheelchairs, hearing aids or prescription eyeglasses) or services of a personal nature (such as eating, toileting or dressing). A traveler who requires services of a personal nature (eating, toileting, help standing, climbing stairs or being pushed in a wheelchair, as examples) must bring a companion to provide such assistance and must understand that other travelers, Trip Managers and Atomic Staff will not be available for such purposes. Atomic cannot guarantee that all cities will have disability access nor can we guarantee accessible accommodations for guests traveling on trips. Our coaches are not accessible and we cannot guarantee space will be available for personal devices (such as luggage with medical supplies, walkers, wheelchairs). You must advise us before booking if you plan to bring a device of such nature.

Atomic does not employ medical personnel. Any necessary medical attention must be sought at a local facility, if available, at the guest’s expense. Atomic is not responsible or liable for losses or costs incurred due to unavailability of medical services, or medical services obtained while on vacation, or for the quality of the care or services received. Medical care in other countries is not always comparable to care that you may receive in your local area.

Travel times on our trips vary from day to day depending on the destination. For your comfort we make regular stops and try to keep each section no longer than 3 hours. However, depending on your medical history, some people may be at risk of discomfort or deep vein thrombosis (DVT) if they remain immobile for a long period on a journey. If you have had DVT, pulmonary embolism, a family history of clotting conditions, cancer, or treatment for cancer, stroke, heart or lung disease, or if you have had major surgery in the past three months, we recommend you consult your doctor before traveling.

SPECIAL TRAVEL REQUESTS

Atomic is happy to provide stay-ahead/stay-behind options, alternate departure airports suggestions, and land-only tour information for individual travelers or the whole group. If you have requested special travel arrangements, Atomic cannot guarantee that you will fly with your group in either direction.

What if only one traveler has a special travel request?

Individual special travel requests should be submitted online at hello@atomictrips.com by 120 days prior to departure. Please keep in mind that you should not make any actual arrangements—such as booking a rental car or hotel—until the final tour itinerary and the departure date has been finalized (around 60 days prior to departure). A $150 service fee plus any additional air and/or land costs will be charged.

What are the types of individual special travel requests?

Individual stay-ahead/stay-behind option: Where possible, Atomic can suggest flight arrangements, hotel accommodations, and transportation options, according to a traveler’s request. Our knowledgeable team can assist you in extending your itinerary before or after the group trip. The cost associated in a stay-ahead/stay-behind option is the sole responsibility of the traveler. Travelers are also responsible for making their own arrangements pertaining to their individual itinerary.

Alternate departure airports: Travelers are responsible for making their own arrangements pertaining to their flight to and from Ireland. Our knowledgeable team can assist you in flight selection. Flights that are suggested by the Atomic Trips Team may be located in a city other than that of your residence, in order to offer a lower cost or a direct flight option. If you accept the suggestion made by an Atomic team member, you are solely responsible for transportation to and from the selected airports as well as the flight costs.

Atomic Trips does not accept responsibility for the purchase or selection of a travelers flight.

ROOMING

Atomic handles final rooming assignments for all travelers. We make rooming assignments based on VIP assignments, medical needs, group dynamics, hotel/castle requirements, and Group Leaders discretion. Please ensure that all special requests are to be submitted at the time your reservation is made.

MISCELLANEOUS

When does the tour officially start and end?

The tour begins upon arrival at the first Atomic hotel and ends upon departure from the last Atomic hotel, according to the itinerary. The official length of an Atomic tour does not include stay-ahead, stay-behind, or any optional periods or activities when travelers are not escorted by a Tour Director.

What about lost belongings?

Atomic Trips and the Tour Group Leader, are not responsible for loss of passports, airline tickets, or other documents, or for loss of or damage to luggage or any other passenger belongings. In the case of lost travel documents, the traveler is solely responsible for meeting the requirements (both logistical and financial) for replacement.

What about travellers with food allergies?

Atomic Trips recognizes that some travelers may have severe food allergies. We will do our best to ensure that our suppliers are informed of the situation, but we cannot guarantee that all requests will be accommodated.

Non-Refundable Fees

Non-Refundable Fees are defined as the non-refundable down payment (15%), and Manual Payment Plan Fee ($50-$150) as well as any late fees, Automatic Payment Plan decline charges, return check/direct debit fees, late special travel request fees and canceled check fees which have been applied to the account at the time of cancellation.

Itinerary Variations

Atomic Trips strives to improve trip itineraries, services and features. If improvements can be made, or if circumstances beyond our control make changes necessary, we reserve the right to vary itineraries and to substitute hotels. At certain peak periods multiple departures may operate, sometimes in reverse order; accommodation may vary from those stated on the itinerary pages. On trips which include cruises, the ship may be changed for operational reasons. Departures in early and late season are potentially operated in cool weather conditions. As a result, itinerary variations may occur.

Certain activities may not be precisely as described or may not be available due to seasonality or weather conditions or other circumstances beyond our control including COVID-19 restrictions and precautions. This may include specific requirements regarding personal protective equipment, such as use of face-masks by staff (and you may be required to wear a facemask as well), social distancing, maximum number restrictions on the use of certain facilities, designated alternative entrance and exit routes, mandatory hand sanitisation, limited entertainment and leisure options and limited food/drink availability. If your enjoyment may be diminished by such limitations, please check with us or your Travel Agent before making a reservation. Please take this risk into consideration when booking your trip.

Changes due to National/Public Holidays

During local or national holidays, certain facilities such as museums, sightseeing trips and shopping may be limited or unavailable. In such instances itinerary changes are made by the Provider seeking to reduce inconvenience to guests. Such changes are deemed not to be a major change to the itinerary, and no compensation will be payable to guests. Holidays, closing days and other circumstances may necessitate a change of the day of the week for scheduled regional meals, sightseeing or other activities. If you feel your enjoyment might be diminished by any of these circumstances, please check with the respective national tourist office before selecting a specific departure date.

How can I protect myself from the risk of COVID-19 while on tour?

Taking personal responsibility for your wellbeing begins with packing any personal protective equipment and sanitizers you require. Adopt physical distancing and hygiene practices throughout your pre-trip travel arrangements and follow all health instruction, whether physical signage or requests from the Tour Director or our staff once on tour.

What items are prohibited from tour?

For the safety and well-being of all travelers, no firearms or any other weapons are permitted on tour except as required by law. No illegal substances will be tolerated on tour,

STANDARD CANCELLATION POLICY

The cancellation policies outlined below take into consideration the costs Atomic Trips incurs often years before groups ever depart. Notice of cancellation from an Atomic tour will only be accepted from the traveler or the Group Leader. The date of cancellation will be determined by the date on which Atomic receives notice. In order to qualify for refunds in accordance with Atomic’s Standard Cancellation Policy, all payments must be received on time.

Cancellation with replacement

Refers to a traveler who cancels but finds a person to replace them for the same program. The replacement’s Enrollment Form must be submitted at the same time as the notification of cancellation.

Conditional Cancelation Policy

At Atomic Trips we understand sometimes circumstances can cause unforeseen, and unplanned cancelations that do not fall within the defined cancelation policies provided by Atomic Trips, in these rare cases our team may opt you into a “Conditional Cancelation” which means we will allow a full or partial refund. The amount to be refunded to the traveler will be determined based on the circumstances of the reason given to cancel.

GROUP LEADER CANCELLATIONS

A Group Leader must accompany travelers on every tour. If a Group Leader cancels for any reason, they will assign a new Group Leader. Any travelers who cancel at this point and choose not to travel with their replacement Group Leader will be treated as standard cancellations. If no replacement Group Leader is found, the affected travelers will need to cancel to be eligible for Atomic’s Conditional Cancellation Policy. Those travelers interested in being placed with a new tour group should contact the Atomic Team at the phone number on your confirmation email. If we cannot find a new tour for these travelers, Atomic Trip’s will refund you in full.

CANCELLATIONS OR MODIFICATIONS REQUIRED BY EXTERNAL EVENTS BEYOND ATOMIC TRIP’S REASONABLE CONTROL

Atomic Trips shall not be liable to any traveler for the need to cancel, modify, or postpone the tour as a result of events that are beyond Atomic’s reasonable control. These matters include such “acts of God” or force majeure events as actual or threats of: epidemics or pandemics, or other public health issues or emergencies (such as but not limited to the current COVID-19 pandemic); severe weather events or natural disasters such as but not limited to hurricanes, earthquakes, tsunamis, tornadoes, fires, floods, volcanic activity, or landslides; war (whether declared or undeclared); terrorist activities; instability in a destination location; incidents of violence, riot, sabotage, civil commotion, or nationalization; strikes or labor disputes or lockouts; government orders, sanctions, actual or potential quarantines, or other restrictions affecting travel in, to, or around a location; disruption to transportation; chemical or radioactive contamination; or any other reason that makes it actually or potentially impossible or illegal for Atomic Trips to conduct the tour as originally contracted. Atomic incurs substantial non-recoverable costs and expenses of its own in planning, preparing, and pre-paying amounts for such tours. Accordingly, if a tour cannot depart as originally scheduled or is interrupted for any such reason, travelers will receive an Atomic Future Travel Voucher in the amount of all monies paid. In the event of a delayed or interrupted tour program, the amount of the Future Travel Voucher will be prorated for the missed portions of the tour. Cancellation, modification, or postponement by Atomic for causes described in this section shall not be a violation of its obligations to any traveler and will not be deemed a “failure” to provide travel services.

COVID-19 CANCELLATIONS, MODIFICATIONS, OR REQUIREMENTS

In the event external events beyond Atomic’s reasonable control have not rendered a tour program impossible or illegal to depart as scheduled yet Atomic Trips reasonably decides in its sole discretion that the program must nevertheless be canceled, modified, or postponed due to health or safety concerns related to the COVID-19 pandemic or because issues related to the COVID-19 pandemic would affect the quality of the program, travelers acknowledge that Atomic’s sole obligation to them will be to issue an Atomic Future Travel Voucher in the amount of all monies paid. In the event of an interrupted tour program, the amount of the Future Travel Voucher will be prorated for the missed portions of the tour. Atomic Trips and the enrolled traveler agree that a cancellation, modification, or postponement by Atomic for causes described in this section shall not be a violation of its obligations to any traveler and shall not be deemed a “failure” to provide travel services.

Atomic Trips is not responsible and shall not be liable to any traveler for any destination imposed travel entry or exit requirement (including countries visited solely in transit), supplier-imposed requirements, or other travel related requirement related to COVID-19, including but not limited to vaccination, testing, or other public health requirements. Customers who are unwilling or unable to comply with such requirements and who choose to cancel their tour are subject to Atomic Trip’s Standard Cancellation Policy. Atomic also reserves the right in its sole discretion to, in good faith efforts to protect against health concerns, exceed destination-imposed travel or entry requirements and require full vaccination against COVID-19, pre-tour and on tour testing for COVID-19, and other public health measures for travelers to certain destination. Travelers who chose to cancel their enrollment upon notification of such
requirements are subject to Atomic Trip’s Standard Cancellation Policy.

Payment Plan Terms and Conditions

Should you choose the Automatic Payment Plan or Manual Payment Plan, the following Terms and Conditions apply.

AUTOMATIC PAYMENT PLAN

Travelers are not charged late fees while enrolled in the Automatic Payment Plan. If the traveler opts to withdraw from the plan or is withdrawn by Atomic, the traveler may be charged for any late fees accrued as a result of being unable to participate in the Automatic Payment Plan.

Paperless Billing Terms and Conditions

All travelers are considered automatically enrolled in Paperless Billing, therefor the following Terms and Conditions apply:

Other Terms and Conditions

The terms and provisions of these Booking Conditions supersede any other warranties, representations, terms, or conditions, unless they are expressly stated within a Booking Conditions Addendum or in a letter signed by an authorized Atomic Trips officer. While Atomic makes every effort to ensure the accuracy of its publications, it cannot be held responsible for typographical or printing errors (including prices). Enrolling travelers acknowledge that Atomic may change the Booking Condition terms from time to time and those changes become effective immediately. Notice will be provided to you in the event of a material change. A traveler’s continued use of Atomic Trip’s services following such notice constitutes acceptance and agreement to be bound by such changes. Travelers agree that the current version of the Booking Conditions in effect at the time of travel or cancellation applies to their tour program.

Disclaimer of Liability

To the maximum extent permitted by law, neither Atomic Trips, its Guides and Operators nor its agents or affiliated entities (“released parties”) shall be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to guests including any results thereof, such as changes in services, accommodations or facilities. Nor shall they be liable for loss or damage to baggage or property, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, omission, default or negligence of any person not its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee. The released parties shall not be liable for indirect, special or consequential damages.

Nothing in this agreement limits any liability which cannot legally be limited, including but not limited to liability for death or personal injury caused by the negligence of the released parties. All baggage and personal effects are at all times and in all circumstances at the risk of the trip participant. Atomic recommends that each guest obtains baggage insurance. After returning at the end of the trip, if lost articles are found and returned to the owner, a service fee will be charged. The Travel Directors, carriers, hotels and other suppliers who provide services on trips are independent contractors; they are not agents, employees or servants of Atomic Trips or its associated companies. All certificates and other travel documents for services issued by Atomic Trips are subject to the terms and conditions specified by the carriers and suppliers and to the laws of the countries in which the services are supplied.

Carriage by sea is subject to the Carrier’s Conditions of Carriage which are expressly incorporated into this contract, copies of which are available upon request. The released parties are not responsible for any criminal or other conduct by third parties, whether criminal, intentional, grossly negligent, negligent or otherwise.

Additional Risks

Additional risks may arise including, but not limited to, hazards of traveling in undeveloped areas, hazards of travel by boat, train, bus, car, truck, aircraft and other means, animals, forces of nature, unrest, differing levels of sanitation, differing safety standards, risks associated with water, drinks, food, plants, insects and animals, diseases and transmission of disease to you or members of your family or party, accident or illness in areas of difficult evacuation or poor medical facilities, acts of governments; all occurring during the trip or while coming to or returning from the trip. You are voluntarily participating, knowing there are risks. You agree to accept any and all risks. You release and discharge the Provider, its related companies and personnel from, and agree not to make a claim against any of them for, any and all claims, known or unknown, arising from contracting for, traveling to or from, or traveling during, and in any and every way participating in a trip, even where caused by negligence of any of these released and discharged persons and entities. This release and discharge of liability, assumption of risk and agreement not to make a claim is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.

Safety

Where the guest occupies a motorcoach seat fitted with a safety belt, neither the Provider nor the Atomic Tour Guides and Operators nor its agents or cooperating organizations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Atomic Trips or Atomic Tour Guides and Operators, or its agents or affiliated entities are liable in other circumstances.

PERSONAL DATA

Atomic Trips will process your personal data in compliance with applicable data protection legislation for the purposes of completing your enrollment, customer service, the purchase of an offered travel protection plan, and providing you with the products and services related to your tour. This may entail sharing your personal data with corporate affiliates, claims handlers, insurance providers, and other business partners both within and outside the U.S.

Atomic may also use your personal data, combined with data from third parties, to market products and services based on your interests, including by email and SMS/text. You may contact Atomic at any time to unsubscribe from any direct marketing purposes. We will only keep your personal data for as long as it is necessary for the purposes for which it has been collected or in accordance with time limits stipulated by law and good market practice, unless further retention is necessary for compliance with a legal obligation or for the establishment, exercise or defense of legal claims. We will keep your personal data for marketing purposes until you withdraw your consent.

If you have questions about the processing or use of your personal data, would like to have a copy of the information Atomic holds about you, or have inaccurate personal data corrected or erased, please contact the Atomic Support team.

On tour, you will meet people who represent a variety of backgrounds and beliefs and explore diverse cultures and histories. Atomic’s Rules of the Road

When you enroll on tour, you agree to Atomic’s Rules of the Road, which can also be found on your personalized website. If you do not conform to these regulations or any specific rules set by your Group Leader, you risk dismissal from the tour, returning home at your expense with no refund for the missed tour portion. Decisions regarding tour dismissal are up to Atomic Trips and/or your Group Leader.

Behavior

The Provider is here to provide the best services possible but in doing so we will not tolerate abusive or aggressive behavior from our guests. We will refuse to deal with and may terminate the vacation of guests who assault our staff, suppliers, fellow guests, or bystanders or those who are abusive or aggressive to them and are generally affecting the enjoyment of others with their behavior and you may be barred from future trips with Atomic Trips.

Undesirable, Not allowed behavior may include (but is not limited to):
(a) verbally abusive or offensive language towards anyone;
(b) bullying behavior;
(c) inappropriate or abusive behavior including uninvited physical contact, harassment, violence or threat of violence;
(d) excessive consumption of alcohol or intoxication;
(e) the possession, carriage or use of restricted substances or drugs (except for medical purposes approved by your doctor);
(f) failure to comply with the Provider’s (including a representative’s) reasonable direction;
(g) conduct which, in the Provider’s opinion, is not compatible with other guests’ general enjoyment and well-being or the smooth operation of the trip;
(h) the possession, carriage or use of dangerous items (such as weapons);
(i) breaking the law of the Country in which you are traveling; and
(j) any behavior or conduct which brings the Provider into disrepute or damage its goodwill.

When you make a booking, you accept responsibility for the proper conduct of all members of your party during your travels with the Provider. We reserve the right at any time and at our discretion to terminate the travel arrangements and/or cease to deal with any party member(s) whose behavior, in the reasonable opinion of us or our suppliers, may cause danger, upset, disruption or distress to anyone else or damage to property. Full cancellation charges will apply and no refund will be made. We shall have no obligation to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation and return transportation arrangements) guest may incur as a result of the travel arrangements being terminated.

All travelers must adhere to the following regulations while on tour:

  1. All scheduled activities are obligatory. If you are sick, have signs of becoming sick, or have a physical ailment that might prevent you from participating in an activity, you must tell the Group Leader, who should notify the Tour Director.
  2. If you want to visit friends or relatives in a destination country, your Group Leader must be told before the tour begins.
  3. Please complete the Tour Leave Form, found on your confirmation email to receive permission for the visits. You must then give the form to your Tour Director upon arrival.
  4. Smoking is not allowed on buses, during meals, in hotel rooms, or in any other shared, enclosed space.
  5. You are required to pay for any phone calls or incidental personal expenses incurred at hotels. These will be payable the evening before departure at each hotel.
  6. Travelers under the age of 18 may not consume alcohol on tour. Travelers over the age of 18 (or older, if local laws require) may consume beer or wine in moderation. Group Leaders and/or Tour Directors may prohibit all alcohol consumption at their discretion. Excessive drinking by any traveler will not be tolerated and will result in dismissal from the tour at the traveler’s own expense.
  7. Illegal activities will not be tolerated and are punishable by immediate dismissal from the tour. If you are involved in any illegal activities, all costs to return home are at your own expense. If the local authorities are involved, you will be subject to the laws of the country you are visiting.
  8. Payment for damage done to hotel rooms or to buses is your responsibility. If you notice any damage upon arrival at a hotel, you should notify the Tour Director immediately.

Choice of Law and Venue Selection

This Agreement is deemed to be entered into in Las Vegas, Nevada. The exclusive venue for any action concerning the interpretation, enforcement, or breach of any term, obligation, or duty as contained or related to these Booking Conditions or any grievance relating to the trip shall be solely in the Superior Court of Nevada or the United States District Court for the Central District of Nevada.

This Agreement shall be construed according to the internal laws of Nevada without regard to conflicts of law principles. All guest claims must be submitted in writing and received by Atomic no later than 60 days after completion of the Atomic Trips vacation. Guest claims not submitted and received within this time shall be deemed to be waived and barred. In any legal action, arbitration, or other proceeding to enforce, interpret or construe the terms of this Agreement, or concerning any grievance relating to the trip, the prevailing party shall be entitled to recover actual reasonable attorneys’ fees, costs and expenses.

Chargeback and Payment Authorization Clause:

By booking with Atomic Trips the traveler agrees to the following chargeback and payment authorization terms:

Chargeback Waiver:

The traveler acknowledges and agrees that they shall not initiate any chargeback requests or disputes with their bank or payment provider for any payments made to the Company, regardless of the reason, including but not limited to dissatisfaction with the trip.

Superseding Rights:

The terms outlined in this contract supersede the traveler’s right to be refunded by initiating chargeback requests through their bank or payment provider. The traveler acknowledges that any dispute or concern regarding the trip shall be addressed according to the terms and conditions outlined in this contract.

Fee for Unauthorized Chargebacks:

In the event that the traveler attempts to favor their preferred outcome by notifying their bank and initiating chargebacks for any or all payments made to the Company, the traveler agrees to a fee of $15 per day until all outstanding funds owed to Atomic Trips are paid in full.

Non-Participation Policy:

If the traveler chooses to ignore or not participate in the chargeback and payment authorization policy stated in this contract, Atomic Trips reserves the right to utilize any legal means necessary to ensure full compensation for both the refunded amount and the daily fee for each day accrued.

Release and Agreement

I (or parent or legal guardian if the enrollee is under 18 or a minor under any other applicable law) have read, understand and agree to the following in exchange for enrollment on an Atomic Trips International Tour:

  1. I acknowledge and understand that my tour is operated outside of the U.S.
  2. M&S Sublets & Services, and their affiliated Tour guides, companies, partners, and any companies acting on their behalf, along with their officers, directors, employees, agents, and authorized representatives (collectively referred to herein as “Atomic”) do not own or operate any entity which is to or does provide goods or services for my program, including, for example, hotels; arrangements for, ownership of, or control over houses, apartments, or other lodging facilities; tour directors; airline, vessel, bus, or other transportation companies; local ground operators; visa processing services; providers or organizers of optional excursions; or food service or entertainment providers; etc. I acknowledge that all such persons and entities, are independent contractors and not employees or agents of Atomic. As a result, Atomic Trips is not liable for any negligent or willful act or failure to act of any such person or entity or of any third party.
  3. Without limitation, Atomic is not responsible for any injury, loss or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God; force majeure; acts of government; acts of war or civil unrest; insurrection or revolt; strikes or other labor activities; public health issues or emergencies, epidemics, pandemics, plagues, outbreaks of infectious disease, mass-illness; criminal, terrorist, or threatened terrorist activities of any kind; overbooking or downgrading of accommodations; structural or other defective conditions in houses, apartments, or other lodging facilities (or in any heating, plumbing, electrical, or structural problem therein); mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely; financial failure or other defaults by suppliers; dangers associated with water-based activities; dangers associated with or bites from animals, insects, or pests; sanitation problems; food poisoning; lack of access to or quality of medical care; difficulty in evacuation in case of a medical or other emergency; or any negligent or willful act or failure to act of any third party or for any other cause beyond the direct control of Atomic Trips.
  4. I agree to release Atomic and my Group Leader, and Tour Director, their affiliated Tour guides, companies, partners, and any companies acting on their behalf, along with their officers, directors, employees, agents, and authorized representatives (collectively, the “Released Parties”) from, and agree not to sue the Released Parties for, any and all claims of any nature related in any manner to my participation in an Atomic Trips International tour, including, but not limited to, claims for negligence, breach of contract, breach of express or implied warranties, negligence or wrongful death, or any statutorily based claim. I hereby unconditionally and unequivocally waive any and all claims and demands for all damages, losses, costs and expenses of any nature whatsoever (including attorneys’ fees) on account of or arising out of any and all personal injury, death, bodily injury, mental anguish, emotional distress, or property or other damage that I may suffer from any cause whatsoever related in any way to my participation in any Atomic tour or a service.
  5. I understand that travel in other nations is not similar to travel within the United States. Travel outside of the United States can involve inconvenience and risk, including, but not limited to, forces of nature, geographic and climatic conditions, different hygienic standards, infrastructure problems (including road maintenance, transportation delays and accommodation conditions), civil unrest, vandalism, crime, political instability, and terrorism. Medical services or facilities may not be readily available or available at all during all or part of a program and, if available, may not be equal to standards in the participant’s home country. I understand that a Atomic Trip International Tour can be a physically demanding excursion in a foreign country, and I knowingly assume the risks of such an excursion. I further understand that different parts of the world present unique health, disease, and safety concerns, and I agree to review any specific risks related to my destination by visiting the U.S. Centers for Disease Control and Prevention’s Traveler’s Health website at www.cdc.gov/travel and the State Department’s International Travel website at travel.state.gov/content/travel/en/internationaltravel.html. I assume all risk of bodily injury, death, emotional trauma, property damage, inconvenience, and/or loss resulting from negligence or any other acts of any and all persons or entities, however caused, including, but not limited to, those risks mentioned above. It is my intention fully to assume all of the risks of travel and participation in the program and to release the Released Parties from any and all liabilities to the maximum extent permitted by law.
  6. I further agree to release the Released Parties from any and all decisions to cancel, modify, or delay the tour as a result of unforeseeable events that are beyond the reasonable control of Atomic or which become necessary or advisable for my safety or for the quality of the tour experience.
  7. I agree that this Release applies to and binds myself and my minor child to enroll on tour (if applicable) along with my personal representatives, executors, heirs, and family.
  8. In addition, Atomic shall have no responsibility for me whatsoever when I am absent from an Atomic supervised activity or for non-supervised activities, such as visits to friends or relatives or during stay-ahead/stay-behind option periods or any other optional period or activity when not escorted by a Tour Director.
  9. My tour begins with my arrival to the first Atomic Hotel and ends upon completion of my checkout at the last Atomic hotel.
  10. The air carrier’s liability for loss of or damage to baggage or property, or for death or injury to person, is subject to and limited by the airlines’ contract of carriage, its tariff, the Montreal Convention or Warsaw Convention and their amendments or both.
  11. Atomic Trips or my Group Leader reserves the right to refuse or cancel my registration at its sole discretion. In such event, Atomic’s Standard Cancellation Policy as outlined in the Booking Conditions apply.
  12. I agree to abide by Atomic’s regulations and the directions of my Group Leader, my Tour Director, and Atomic’s personnel during my tour. Failure to do so may result in my Group Leader or Atomic Trips, terminating me from the tour immediately. I understand that to disobey such rules or directions is to waive the right to a refund of any part of my program price, and that my Group Leader or Atomic may then send me home at my own expense.
  13. I agree to abide by all local laws, regulations, and governmental advisories for all locations of my tour while abroad. I understand that if I refuse to follow, abuse, or disobey those laws, even unintentionally, I waive my right to a refund of any part of the program price, and my Group Leader or Atomic may send me home at my own expense. I also understand that, should local authorities be involved, I will be subject to the laws of the country I am visiting.
  14. If I become ill or incapacitated, Atomic and their employees, my Tour Director, or my Group Leader, may take any action they deem necessary for my safety and wellbeing, including notifying and/or securing medical treatment (at my own expense) and transporting me home. These rights transcend any and all privacy regulations that may apply. In the event of a medical emergency, Atomic will attempt to cause appropriate treatment to be administered, and the traveler authorizes Atomic to do so. Atomic, however, makes no warranty that it will be able to cause effective (or any) emergency treatment to be administered or to be timely administered.
  15. If I will be age 18 or older at any time during my tour, I acknowledge that Atomic will conduct a criminal background check (“CBC”) as a pre-condition to travel. If such a traveler refuses to consent to the CBC, it will be deemed a cancellation and Atomic’s Standard Cancellation Policy will apply.
  16. This Release and Agreement and Atomic’s Booking Conditions constitute the entire agreement between Atomic and me with reference to the subject matter herein, and I do not rely upon any promises, inducements, marketing materials, or agreements not herein, including, but not limited to, any oral statements made to me by any agents or employees of Atomic or Group Leader. This agreement may be amended or modified only in writing, signed by Atomic. The waiver by Atomic of any provision of this agreement shall in no way affect the remaining provisions of this agreement, and this agreement shall be interpreted as if such clause or provision were not contained herein.
  17. This agreement and performance hereunder shall be governed in all respects by the substantive laws of the State of Nevada. In the event of any claim, dispute, or proceeding arising out of my relationship with Atomic, or any claim which arises between the Parties, whether or not related to this agreement, the literature for the trip or the trip itself, it shall be resolved solely in courts of the State of Nevada and/or the United States District Court for the District of Nevada.
  18. Atomic Trips and its affiliates may use any film or digital likeness taken of me and any of my comments while on an Atomic tour for future publicity without compensation to me and also use my contact information for future Atomic Trip promotions. I have read and agreed to the Terms of Use and Privacy Policy and I consent to Atomic’s processing of my personal data.
