Important – relationship to Terms & Conditions
These Bylaws and Member Agreement (the “Bylaws”) are incorporated into and form part of the Atomic Trips Terms & Conditions (the “Terms”). By joining the $5 Travel Club or booking or participating in any Atomic Trips program, you agree that:
1. The Terms & Conditions are the primary contract between you and Atomic Trips.
2. These Bylaws supplement the Terms by setting more detailed membership, conduct, operational, and safety rules.
3. If there is a direct conflict between these Bylaws and the Terms, the Terms will control, except that any stricter conduct, safety, or operational requirements in these Bylaws will apply in addition to the Terms.
4. Nothing in these Bylaws is intended to waive any non-waivable statutory rights under applicable law. The enforceability of these Bylaws and the Terms will be determined in accordance with the governing law, venue, and dispute resolution provisions set out in the Terms.
11. RIGHT TO REFUSE SERVICE OR PARTICIPATION
11.1 Purpose
11.1.1 Atomic Trips must preserve safety, schedule integrity, vendor relationships, and the quality of experience purchased by all travelers. This Section grants Atomic Trips clear authority to refuse, limit, or withdraw participation when conduct, preparedness, or circumstances jeopardize those interests.
11.2 Authority
11.2.1 The Trip Lead and designated staff have discretion to make field decisions that are effective immediately.
11.2.2 Decisions may be based on direct observation, credible reports from staff, vendors, or travelers, or documented non-compliance with these bylaws.
11.3 Grounds for Refusal or Withdrawal
11.3.1 Any one of the following is sufficient:
(a) Safety risk. A traveler’s condition or conduct presents a risk to self, others, staff, or the public, including intoxication before an activity requiring balance or attention, ignoring safety instructions, or entering restricted areas.
(b) Operational disruption. Persistent lateness, refusal to follow timing, or behavior that causes missed entries, vendor breaches, or material schedule slippage.
(c) Harassment or abuse. Any conduct violating Sections 3, 4, 9, or 10, including aggression toward staff, vendors, or travelers.
(d) Non-compliance with essential eligibility. Inability to meet Section 7 requirements with reasonable accommodations that do not materially alter the program.
(e) Prohibited items. Possession, purchase, display, or transport of a weapon or weapon-like souvenir, or other contraband under Section 32.
(f) Fraud or misrepresentation. False documents, forged insurance, name mismatch not corrected after notice, concealed medical issues that create safety risk.
(g) Illegal activity. Violations of local laws, including controlled substances, vandalism, or disorderly conduct.
(h) Vendor or venue refusal. A property or provider declines service to the traveler for cause and will not reverse the decision.
(i) Failure to cure. Continued violations after a written or verbal directive to correct.
11.4 Scope of Actions Available
11.4.1 Temporary Pause
(a) Short cooling off period or temporary separation from an activity.
11.4.2 Conditions for Return
(a) Requirements such as hydration, meal intake, sobriety, attire change, or agreement to sit out a segment.
11.4.3 Activity Exclusion
(a) Removal from one or more activities, meals, or transfers without refund.
11.4.4 Itinerary Restrictions
(a) Reassignment of seating, subgrouping, or rooming to protect safety and flow.
11.4.5 Trip Removal
(a) Immediate removal from the trip for serious or repeated violations, with forfeiture of all payments and permanent loss of membership.
11.5 Immediate Removal Criteria
11.5.1 Removal may be immediate without prior warning where:
(a) There is a credible threat or act of violence or harassment toward staff, travelers, or the public.
(b) The traveler brings or acquires a weapon or weapon-like item in violation of Section 32.
(c) Intoxication or drug use creates an unsafe condition for the traveler or the group.
(d) Conduct causes a vendor to refuse service or threatens revocation of services for the entire group.
(e) Illegal activity, theft, or property damage is reasonably suspected or observed.
11.6 Refunds and Credits
11.6.1 Amounts paid are non-refundable when refusal or removal is based on the traveler’s conduct, non-compliance, or prohibited items.
11.6.2 Unused services are not credited. Vendor-issued refunds, if any, are handled under Sections 23, 24, and 26 and only to the extent actually recovered.
11.7 Cost Responsibility
11.7.1 All incremental costs arising from refusal or removal, including additional hotels, transport, flight changes, vendor penalties, security fees, and administrative expenses, are the traveler’s responsibility.
11.7.2 Atomic Trips may assist with information as a courtesy but has no obligation to coordinate or fund replacement arrangements.
11.8 Documentation
11.8.1 Staff may prepare a brief written note summarizing the basis, timing, and witnesses, and may retain relevant messages from Official Channels.
11.8.2 Where lawful and reasonably necessary, limited audio or video evidence may be preserved.
11.9 Appeal and Review
11.9.1 Field decisions are effective immediately and are not stayed by an appeal.
11.9.2 A traveler may submit a written appeal within ten (10) business days after the trip concludes. Atomic Trips will review and respond in writing.
11.9.3 Appeals do not create an entitlement to refunds or reinstatement.
11.10 Vendor and Venue Independence
11.10.1 Vendors and venues may impose their own rules and refusals. Atomic Trips cannot override a vendor’s lawful decision to deny service.
11.10.2 If a vendor refusal affects only the traveler at fault, the group program proceeds as planned.
11.11 Reinstatement and Future Eligibility
11.11.1 Following removal, membership is terminated unless otherwise stated in writing.
11.11.2 Any future participation requires written approval by Atomic Trips management after a cooling off period and may include additional conditions. There is no entitlement to reinstatement.

12. COMMUNICATION AND PERSONAL RESPONSIBILITY
12.1 Purpose
12.1.1 Clear, timely communication is essential for safety, scheduling, and the quality of the group experience. Every traveler has a duty to stay informed, to ask questions promptly, and to alert Atomic Trips to any issue that could affect safety, timing, or cohesion.
12.2 Standard of Care
12.2.1 Members must use Official Channels for trip communications. Official Channels are email, the Atomic Trips app, and the designated WhatsApp group.
12.2.2 Verbal instructions given during briefings or at muster points are binding. Staff may summarize key directives in writing as time permits.
12.2.3 Members are responsible for receiving, reading, and understanding notices. The fact that a message was posted in Official Channels is sufficient notice.
12.3 Technology Readiness
12.3.1 Maintain an internet-enabled phone with WhatsApp installed, notifications enabled, and sufficient battery each day.
12.3.2 Ensure access to the email address used at booking and to the Atomic Trips app.
12.3.3 Arrange international data service through roaming, eSIM, or local SIM before departure. Lack of connectivity does not excuse missed instructions.
12.4 Responsiveness Expectations
12.4.1 Acknowledge critical updates in the app or WhatsApp when a read receipt or acknowledgement is requested by staff.
12.4.2 When staff requests a confirmation of a time change, meet point pin, or document receipt, respond promptly.
12.4.3 If you cannot respond immediately due to flight or transit, acknowledge as soon as practicable and check for any follow up actions.
12.5 Duty to Ask Questions
12.5.1 If any instruction is unclear, ask a clarifying question in Official Channels within forty-eight (48) hours of the notice or as soon as the question arises on trip.
12.5.2 Ask questions privately when the topic could trigger unnecessary group debate or negativity.
12.5.3 Questions asked early will be prioritized over last minute requests that could delay the group or breach vendor timing.
12.6 Change Management
12.6.1 Report changes to flights, contact numbers, dietary notes, or roommate status within forty-eight (48) hours of the change.
12.6.2 Material changes that affect manifests or vendor timing may require Atomic Trips approval and may incur costs.
12.6.3 Update your Traveler Profile in the app and notify staff in WhatsApp or the Help Center when the change could impact the next seventy-two (72) hours of programming.
12.7 Travel Day Communications
12.7.1 On travel days, keep your phone accessible and ringer on vibrate. Monitor the WhatsApp group and app for gate changes, transfer windows, and meet point updates.
12.7.2 If your flight is delayed or cancelled, notify Atomic Trips immediately with the new estimated arrival time and any rebooked flight details.
12.8 Personal Responsibility for Preparedness
12.8.1 Review the Daily Brief each evening or morning before departure. Know lobby call times, attire notes, and bag pulls.
12.8.2 Pack the day bag items specified by staff such as water, layers, modesty wear, and site-specific tickets if issued.
12.8.3 Bring and manage your own medications, emergency devices, and sunscreen or rain gear as needed for the day’s plan.
12.9 Grievance and Discomfort Reporting
12.9.1 If you feel unwell, unsafe, uncomfortable, or targeted by conduct that violates these bylaws, inform Atomic Trips staff promptly and privately.
12.9.2 Early reporting allows quiet resolution before issues spread. Choosing not to report and later asserting that the issue ruined the trip does not create an entitlement to refunds or credits.
12.10 Respect for Channel Purpose
12.10.1 The WhatsApp group is for real-time coordination, timely questions, and positive engagement. Off-topic rants, sarcasm intended to provoke, or call-outs that embarrass others are prohibited.
12.10.2 For non-urgent or sensitive topics, use the Help Center in the app or speak directly with the Trip Lead.
12.11 Accuracy and Truthfulness
12.11.1 Provide accurate information in all communications. Do not exaggerate or omit facts in ways that could mislead staff or vendors or that could harm others.
12.11.2 Submitting false documents or statements is grounds for removal and permanent loss of membership.
12.12 Confidentiality
12.12.1 Do not share screenshots or internal messages outside the group without permission. Respect traveler privacy when discussing incidents with staff.

12.13 Acknowledgement Requests
12.13.1 Atomic Trips may require affirmative acknowledgement for critical notices such as time changes, safety protocols, or visa reminders.
12.13.2 Failure to acknowledge after a reminder may result in activity exclusion when safety or vendor compliance requires confirmed receipt.
12.14 Off Hours Policy
12.14.1 Staff will identify duty hours when relevant. Use the Help Center for non-urgent matters after hours.
12.14.2 Overnight messages should be reserved for time-sensitive logistics or safety. Persistent off-hours messaging after a request to use official pathways may be limited.
12.15 Documentation
12.15.1 Atomic Trips may document key communications, acknowledgements, and incident reports to ensure consistent enforcement and to defend against claims.
12.15.2 Members are encouraged to keep brief personal notes for clarity and to share relevant facts with staff when requested.
12.16 Consequences for Communication Failures
12.16.1 Missed meet-ups, transfers, or activities due to failure to read or acknowledge Official Channel messages are non-refundable.
12.16.2 Repeated failure to engage in Official Channels or to respond to direct requests may result in temporary suspension of app features, activity exclusion, or removal from the trip as outlined elsewhere in these bylaws.
12.17 Illustrative Examples
12.17.1 Acceptable: responding “received” in WhatsApp when the Trip Lead posts an earlier lobby call and updating your alarm accordingly.
12.17.2 Unacceptable: ignoring the earlier lobby call, arriving late, and asserting that you did not see the message even though it was posted in the group the prior evening.
12.17.3 Acceptable: opening a Help Center ticket to clarify a dress code for a religious site and sharing the response in the group for others’ benefit.
12.17.4 Unacceptable: posting in the group that “nothing was explained” when three Zoom calls and pinned messages covered the topic.
12.17.5 Acceptable: privately telling staff that a roommate conflict is affecting your sleep and asking for mediation.
12.17.6 Unacceptable: accusing a roommate in the WhatsApp group of being inconsiderate and demanding an immediate room change at midnight.

13. TRIP INTERRUPTION AND MISSED CONNECTIONS
13.1 Purpose
13.1.1 This Section defines responsibilities and procedures when flights are delayed or cancelled, luggage is lost, or a traveler otherwise fails to meet the group on time. The goal is to protect the schedule, vendor windows, and the experience purchased by all travelers while giving a clear path for catching up.
13.2 Traveler Responsibility for Punctuality
13.2.1 Arrive at lobby calls, transport windows, and timed entries at or before the posted time.
13.2.2 Build buffers into personal schedules for jet lag, airport security, traffic, and weather.
13.2.3 Keep your phone charged and watch Official Channels for day-of adjustments.
13.3 If Your Inbound Flight Is Delayed or Cancelled
13.3.1 Notify Atomic Trips immediately through WhatsApp and the Help Center with your new estimated arrival time, airline messages, and any rebooked flight numbers.
13.3.2 Work directly with your airline to obtain the earliest feasible rebooking. Accept reasonable re-routings and partner carriers.
13.3.3 Atomic Trips will provide a meet point and catch up plan if one exists that does not disrupt the group program.
13.3.4 All costs to reach the meet point, including hotels, meals, new tickets, or private transfers, are the traveler’s responsibility and are typically claimable to travel insurance.
13.4 If You Miss a Group Departure or Timed Entry On Trip
13.4.1 The group will depart on schedule to protect vendor windows.
13.4.2 Staff may identify a logical rejoin point and timing. If rejoining would cause the group to miss contracted services, you will be directed to a later meet point.
13.4.3 Missed tours, meals, tastings, or activities due to lateness or personal choice are non-refundable.
13.5 Lost or Delayed Luggage
13.5.1 File a report with the airline before leaving the airport and obtain the Property Irregularity Report or local tracking number.
13.5.2 Provide your hotel address and ensure a person can accept delivery.
13.5.3 Purchase necessary replacement items and keep receipts for insurance claims.
13.5.4 Atomic Trips may assist with a short shopping window only if it does not disrupt the group program. Extended shopping is at your leisure time and expense.
13.6 Independent Transport to Catch Up
13.6.1 If you must use a taxi, rideshare, train, or regional flight to rejoin, confirm the meet point and time with staff in writing.
13.6.2 Choose reputable carriers. Keep tickets and receipts for insurance.
13.6.3 Atomic Trips is not responsible for additional delays, overbooking, or cancellations on independent transport used to catch up.
13.7 Weather, Strikes, and Systemic Disruptions
13.7.1 When widespread disruptions occur, Atomic Trips will prioritize the greatest good for the group and will adjust timing or sequence where feasible within vendor and legal constraints.
13.7.2 If the first scheduled activity or meal is missed due to systemic disruption, the group program proceeds from the earliest viable point. Credits are not guaranteed and are subject to vendor recovery under Section 26.
13.8 Medical or Personal Emergencies
13.8.1 If you must pause to seek treatment or address a personal emergency, notify staff as soon as practicable.
13.8.2 Staff can provide local clinic or hospital information as available.
13.8.3 Rejoining the group later is permitted when safe and feasible. All related costs are the traveler’s responsibility.
13.9 Documentation for Claims
13.9.1 Keep airline notifications, delay or cancellation notices, baggage reports, receipts, and any written instructions from Atomic Trips.
13.9.2 Your travel insurance provider may require evidence of delays, missed connections, or additional expenses to process claims.
13.10 No Show and Early Departure
13.10.1 Failure to appear for the trip start without notice is a no show and is non-refundable.
13.10.2 Early departure for personal reasons is non-refundable. You may continue to use any independent bookings you control at your own discretion.
13.11 Group Integrity and Non-Disruption Rule
13.11.1 The group program will not be re-timed or re-staged to accommodate an individual traveler’s delay or luggage issues.
13.11.2 If a traveler’s repeated lateness creates a pattern of disruption, staff may exclude the traveler from subsequent timed activities or transfer segments without refund.
13.12 Illustrative Timelines and Outcomes
13.12.1 Inbound flight arrives late at 18:45, dinner starts at 19:30. Catch up at dessert or join the group at the hotel afterward. Dinner is a missed service and non-refundable.
13.12.2 Train strike affects a day trip. Staff shifts to an alternate venue reachable by coach. The original rail museum is dropped. No refund if the alternate is of comparable value.
13.12.3 Traveler oversleeps a lobby call. Group departs. Traveler takes a taxi to the first venue and rejoins at the agreed time. Missed transport and entry are non-refundable.
13.12.4 Bag is lost and traveler wants to shop. Staff identifies a 30-minute window near the lunch venue without impacting timing. Additional shopping occurs during free time.

14. SUBSTANCE USE AND ALCOHOL GUIDELINES
14.1 Purpose
14.1.1 These standards protect traveler safety, vendor relationships, schedule integrity, and the welcoming culture of the 5 Dollar Travel Club. Alcohol may be part of culinary and cultural experiences, but participation must never impair judgment, create risk, or diminish others’ enjoyment.
14.2 General Principles
14.2.1 Alcohol use is optional. No traveler should feel pressured to drink.
14.2.2 If you choose to drink, you must remain in control of your behavior, tone, and mobility.
14.2.3 Intoxication is not a defense for misconduct, lateness, missed services, or unsafe behavior.
14.2.4 Illegal drugs are prohibited at all times.
14.3 Permitted Consumption
14.3.1 Alcohol may be consumed during designated tastings, meals, or free time, subject to local laws and venue policies.
14.3.2 Follow staff guidance regarding appropriate times and places to drink. Public consumption may be restricted by law in some destinations.
14.4 Prohibited Conduct Relating to Alcohol
14.4.1 Drinking before or during activities that require balance, attention, or coordination, such as boat segments, stair climbs, or crowded transfers.
14.4.2 Public intoxication, slurred or aggressive speech, or behavior that disturbs other guests, vendors, or members of the public.
14.4.3 Pressuring others to drink or mocking those who abstain for any reason, including health, faith, or recovery.
14.4.4 Bringing outside alcohol into venues that prohibit it or consuming alcohol on vehicles where it is not permitted.
14.4.5 Tampering with drinks, leaving drinks unattended in risky environments, or encouraging drinking games during group programming.
14.4.6 Using alcohol as a pretext to engage in harassment, boundary crossing, or unsafe decisions.
14.5 Non-Alcoholic Alternatives
14.5.1 Where tasting menus include wine or beer pairings, a non-alcoholic alternative may be requested in advance at select venues, subject to feasibility. Alternatives are not guaranteed at every stop.
14.5.2 If you are abstaining, inform staff before courses are poured to avoid waste and vendor charges.
14.6 Illegal Substances and Controlled Drugs
14.6.1 Possession, purchase, or use of illegal substances under local law is strictly prohibited.
14.6.2 Medication that is legal at home may be restricted or illegal abroad. Travelers are responsible for confirming legality and documentation. See Section 33.
14.6.3 Discovery of illegal substances may result in immediate trip removal, notification of authorities, and permanent loss of membership.
14.7 Medication and Alcohol Interactions
14.7.1 Travelers are responsible for understanding interactions between alcohol and their medications or health conditions.
14.7.2 If staff reasonably believes consumption would create an acute safety risk, staff may instruct the traveler not to drink during a group function.
14.8 Vendor and Venue Policies
14.8.1 Respect venue-specific rules regarding service limits, ID checks, glassware outdoors, and last call.
14.8.2 Venues may refuse service to a traveler who appears intoxicated or disruptive. Atomic Trips will not override a venue’s lawful decision.
14.9 Staff Discretion and Field Decisions
14.9.1 The Trip Lead may limit or prohibit an individual’s alcohol consumption during a group function if behavior, tone, balance, or judgment is degrading.
14.9.2 Staff may reseat, separate, or temporarily remove a traveler from an activity to de-escalate.
14.9.3 Where alcohol is integral to a tasting format, staff may arrange a non-alcoholic option if feasible or recommend a brief step out and rejoin later.
14.10 Safety Practices When Drinking
14.10.1 Eat before or with alcohol. Alternate with water.
14.10.2 In crowded settings, keep drinks in hand and do not accept drinks from unknown persons.
14.10.3 Use the buddy system when moving at night. Use licensed taxis or rideshare from known pickup points.
14.10.4 If you begin to feel unwell or dizzy, tell staff or your buddy immediately.
14.11 Incident Response
14.11.1 If alcohol-related behavior threatens safety or disrupts operations, staff may:
(a) Issue a verbal directive to stop drinking, lower voice, or step outside.
(b) Exclude the traveler from the current activity or transfer without refund.
(c) Impose conditions for return, such as rehydration, a meal, or a fixed time out.
(d) Arrange private transport at the traveler’s expense if the traveler cannot safely continue with the group.
(e) Remove the traveler from the trip for serious or repeated violations.
14.12 Costs and Liability
14.12.1 Any vendor fines, cleaning fees, damages, or administrative costs arising from alcohol-related incidents are the traveler’s responsibility.
14.12.2 Missed services due to intoxication or hangover are non-refundable.
14.12.3 Medical costs arising from alcohol consumption are the traveler’s responsibility and are typically claimable to travel insurance.
14.13 Respect for Others’ Choices
14.13.1 Do not criticize, shame, or interrogate travelers who abstain.
14.13.2 Travelers in recovery or who prefer not to discuss their reasons are entitled to privacy.
14.14 Illustrative Examples
14.14.1 Acceptable: sipping wine during a tasting, drinking water between pours, and participating in the discussion respectfully.
14.14.2 Unacceptable: arriving to a boat embarkation visibly intoxicated and arguing about wearing a life vest.
14.14.3 Acceptable: requesting a non-alcoholic pairing before a prix fixe dinner so pours are not prepared.
14.14.4 Unacceptable: pressuring a traveler in recovery to “just have one” and ridiculing them for abstaining.

15. SMOKING, VAPING, AND SUBSTANCE AREAS
15.1 Purpose
15.1.1 This Section protects health, comfort, and vendor relationships by setting clear limits on smoking and vaping behaviors during group travel.
15.2 Scope and Definitions
15.2.1 Smoking includes cigarettes, cigars, pipes, and heated tobacco products.
15.2.2 Vaping includes e-cigarettes and any aerosolized nicotine or non-nicotine liquids.
15.2.3 Group environments include coaches, trains, boats, hotel rooms, balconies attached to rooms, lobbies, restaurant dining rooms, guided tours, ticket queues, venue grounds, and any area where the group is gathered for programming.
15.3 General Rule
15.3.1 Smoking and vaping are prohibited in group environments unless you are in a legally designated outdoor smoking area and staff confirms that use there does not conflict with local rules or vendor policies.
15.4 Property and Venue Rules
15.4.1 Many hotels, restaurants, museums, transport operators, and attractions are strictly non-smoking, including balconies and terraces.
15.4.2 Where a property provides a designated smoking area, use only that area and follow posted hours and disposal rules.
15.4.3 Local laws may ban smoking or vaping in public parks, beaches, or near building entrances. Compliance is mandatory.
15.5 Vehicles and Transfers
15.5.1 No smoking or vaping in coaches, vans, taxis arranged by Atomic Trips, boats, trains, or while boarding or queuing for transport.
15.5.2 Drivers may stop at rest points on longer transfers when feasible. Rest stops are not guaranteed and are subject to timing and vendor windows.
15.6 Hotel Rooms and Balconies
15.6.1 Do not smoke or vape in hotel rooms or on attached balconies unless a room is expressly designated for smoking by the property. Most partner hotels are fully non-smoking.
15.6.2 Deodorizing charges, cleaning fees, and sprinkler or alarm activation fees assessed by the property are the traveler’s responsibility and may be charged to the card on file.
15.7 Proximity to Others
15.7.1 Even in permitted outdoor areas, maintain a respectful distance from group members who do not wish to be exposed to smoke or vapor.
15.7.2 Move downwind and avoid doorways and queues.
15.8 Devices, Cartridges, and Storage

16.3 Hotel Rooms and Accommodations
16.3.1 Keep critical items such as passports and electronics in your possession or secured in your luggage when you are in the room.
16.3.2 We do not recommend using in-room safes because travelers frequently forget items inside and retrieval can be difficult during early departures. If you choose to use a safe, set a departure reminder.
16.3.3 Do not leave valuables visible on nightstands or desks. Keep curtains closed in street-level rooms when you are away.
16.4 Transport and Day Movements

18.4.2 Unused services. Missed or unused activities, meals, tickets, accommodations, or transport segments will not be refunded or credited.
18.4.3 Membership status. Removal may result in permanent termination of 5 Dollar Travel Club membership. Reinstatement, if ever considered, is at the sole discretion of Atomic Trips management.
18.4.4 Independent arrangements. A removed traveler must arrange and pay for their own accommodations, transport, meals, and onward travel from the point of removal. The group program will continue as scheduled.
18.5 Cost Responsibility
18.5.1 The traveler is responsible for all incremental costs arising from exclusion or removal, including alternative lodging, private transport to retrieve luggage, change fees, fare differences, vendor penalties, security charges, property damages, cleaning fees, and reasonable administrative expenses.
18.5.2 If Atomic Trips advances funds to resolve an immediate safety or property issue caused by the traveler, the traveler authorizes Atomic Trips to charge the payment method on file or to invoice for reimbursement within ten business days.
18.6 Process and Notice
18.6.1 Field decisions are effective immediately to protect safety and operations.
18.6.2 Staff will provide a brief verbal statement of the reason for exclusion or removal and may follow with a short written note summarizing time, place, and basis.
18.6.3 Where immediate removal is ordered, staff will designate a safe location for the traveler to disembark and will provide local information for taxis, hotels, or airports as a courtesy. Coordination beyond this courtesy is not required.
18.7 Appeal and Review
18.7.1 A written appeal may be submitted within ten business days after the trip concludes.
18.7.2 Appeals do not pause or reverse field decisions and do not create entitlement to refunds or credits.
18.7.3 Atomic Trips will review and respond in writing. Decisions after review are final.
18.8 Chargebacks
18.8.1 Initiating a chargeback contrary to this policy and Section 24 without first providing Atomic Trips a written opportunity to resolve the issue is a breach of these bylaws.

18.9.1 Travel insurance may cover certain expenses such as new transport or lodging in limited scenarios, but policies typically exclude losses caused by misconduct. Travelers should consult their policy documents. Atomic Trips does not guarantee insurance outcomes.
18.10 Documentation
18.10.1 Atomic Trips may retain contemporaneous notes, copies of messages in Official Channels, and vendor statements that support the decision and the associated financial consequences.
18.11 Examples
18.11.1 A traveler verbally abuses a server and refuses to stop after a staff directive. The venue refuses further service and asks the traveler to leave. The traveler is excluded from the dinner and responsible for their own meal and transport. No refund is issued.
18.11.2 A traveler arrives intoxicated to a boat embarkation and ignores crew safety instructions. Staff orders removal for safety. The traveler must arrange a taxi to the hotel and pays for missed services and any rebooking fees.
18.11.3 A traveler brings a prohibited blade purchased as a souvenir into a group environment. After refusing to surrender or ship it lawfully, the traveler is removed from the trip. All costs to depart early are the traveler’s responsibility.

19.4 Independent Contractors and Third Party Services
19.4.1 Airlines, rail operators, bus companies, rideshares, ferries, hotels, restaurants, attractions, guides, activity providers, and equipment rental firms are independent contractors and not agents or employees of Atomic Trips.
19.4.2 Atomic Trips is not responsible for their acts, errors, omissions, negligence, overbooking, cancellations, schedule changes, or property rules.
19.4.3 Travelers may be required to sign vendor waivers and follow provider safety rules as a condition of service.
19.5 Information Accuracy and Changes
19.5.1 While Atomic Trips endeavors to present accurate descriptions and timing, circumstances can change. Descriptions of amenities, menus, room types, or activities are based on information provided by vendors and are subject to change without notice.
19.5.2 If an advertised feature becomes unavailable, Atomic Trips may substitute a reasonable alternative or adjust sequencing consistent with Section 42.
19.6 Medical and Dietary Limitations
19.6.1 Atomic Trips is not a medical provider and does not render medical advice or administer medications.
19.6.2 Dietary accommodations and allergen controls are limited by vendor capabilities and local infrastructure. Zero cross-contact environments are not guaranteed. See Section 6.

20.3 Standards of Conduct and Proof
20.3.1 Standard of proof. Decisions are based on a preponderance of evidence, meaning it is more likely than not that a violation occurred.
20.3.2 Evidence types. Staff observations, traveler statements, vendor reports, contemporaneous notes, screenshots of Official Channels, and where lawful, limited photo or audio evidence. Anonymous statements may be considered with caution.
20.3.3 Relevance. Only facts bearing on the incident are considered. Prior good or bad behavior may be weighed when relevant to pattern or remedy.

20.5.2 Interim measures. Staff may reseat, regroup, separate parties, assign different tables or coaches, or pause a traveler’s participation in an activity while facts are gathered.
20.5.3 Non-retaliation. Retaliation against any traveler or staff who reports a concern or participates in an investigation is prohibited and may lead to removal.
20.6 Investigation Steps
20.6.1 Obtain brief statements from involved parties and any witnesses when feasible without disrupting operations.
20.6.2 Review relevant messages in Official Channels and vendor notes.
20.6.3 Where timing or safety prevents full inquiry, staff may implement a temporary remedy and complete the review at the soonest practical time.
20.7 Progressive Remedies and Sanctions
20.7.1 Atomic Trips may use one or more of the following, depending on severity and context:
(a) Coaching and expectations reset. A directive to stop the conduct, modify tone, or comply with a posted rule.
(b) Written note. A brief written summary of the incident and expectations for future conduct.
(c) Conditions for continued participation. Requirements such as sobriety for the remainder of the day, seating changes, or avoiding direct interaction with another traveler.
(d) Activity exclusion. Removal from one or more meals, activities, transfers, or venues without refund.
(e) Cost shifting. Charging the traveler for vendor penalties, property damages, additional lodging, private transport, or administrative expenses caused by the conduct.
(f) Trip removal. Immediate removal from the trip for serious or repeated violations, with forfeiture of all payments and permanent loss of membership.
(g) Membership actions. Suspension or termination of $5 Travel Club membership, and blocks on future bookings.
20.8 Restorative Options Where Appropriate
20.8.1 For lower-level conflicts, staff may offer a voluntary restorative conversation mediated by a Trip Lead after a cooling period.
20.8.2 Participation is optional for the affected party and is not required for enforcement.
20.9 Documentation and Records
20.9.1 Staff may keep contemporaneous notes, copies of relevant messages, and vendor statements.
20.9.2 Records are maintained for a commercially reasonable period to ensure consistency and to defend against claims, consistent with the Data Privacy Section.
20.10 Appeal Process
20.10.1 On trip decisions. Field decisions take effect immediately and are not stayed by an appeal.
20.10.2 Post-trip appeal. A traveler may submit a written appeal within ten business days after trip end, stating the decision challenged, specific grounds, and any new information.
20.10.3 Review. Management will review and respond in writing. Remedies may be affirmed, modified, or lifted. This internal review is a prerequisite to any external dispute process.
20.11 Financial Consequences
20.11.1 Refunds are not provided for services missed due to enforcement actions.
20.11.2 The traveler is responsible for incremental costs caused by the conduct, as outlined in Section 18.
20.11.3 Chargebacks initiated contrary to Sections 18 and 24 are a breach of these bylaws.
20.12 Confidentiality and Privacy
20.12.1 Atomic Trips will share information about an investigation only with those who need to know to resolve the issue, including vendors if their cooperation is required.
20.12.2 Travelers must not publish internal messages, screenshots, or allegations publicly during an ongoing review. See Section 27.
20.13 Coordination with Vendors and Authorities
20.13.1 Vendors may impose their own rules and sanctions. Atomic Trips cannot override a vendor’s lawful decision to refuse service.
20.13.2 Where required by law or necessary to protect safety, Atomic Trips may notify local authorities and cooperate with lawful requests.
20.14 Relationship to Arbitration and Venue
20.14.1 This enforcement framework operates alongside Section 28, which governs legal jurisdiction and binding arbitration for disputes not resolved through internal review.
20.14.2 Nothing in this Section waives Atomic Trips right to seek emergency relief when necessary to protect safety, property, or brand reputation.
20.15 Illustrative Pathways
20.15.1 Disruptive intoxication at a tasting. Coaching and water first, seating change, then exclusion from the next activity if behavior persists. Trip removal if the conduct continues later the same day.
20.15.2 Harassment in the WhatsApp group. Immediate directive to stop, message deletion if feasible, written note, and exclusion from the next group meal if the tone continues.
20.15.3 Aggression toward staff. Immediate separation, activity exclusion, and likely trip removal under Section 10 and Section 11.
